Just realised my post title should say looking for help... it reads like I am offering help!! I can offer support and empathy but I am afraid that is about it!!
Hi all,
I am a little all over the place and this is possibly not the best place to ask, but I will anyway and would be really grateful if anyone has any advise...
I am a partner of someone who has been falsely accused. We do not live together (that was this years plan!). I have children from my previous marriage.
My partner is on a police charge, but has not been formally charged (Scottish Law) he has no bail or conditions and no date for a court appearance.
My ex has stated he does not want my partner to see our children. He is adamant that he does not want 'a rapist' around our kids. He has threatened to take out a court order and contact Social Services if my partner is to see the kids.
I agreed to this (under duress) while I took legal advice as I really don't want my children to suffer anymore that they have already and their dad was putting them under massive pressure and was verbally abusive and intimidating towards myself (I wish I has called the police now, but have no faith in them anyway)
I contacted the lawyer who I did my formal separation with and she has advised that he will not get a court order for the following reasons.
1 - An allegation has been made against my partner at this time the police have not proceeded with it (although that could change)
2 - The children are not at risk - this is a consent issue, in no way a threat to children.
3 - It would cost him thousands to attempt to get on
4 - She says that a lawyer would advise if he felt his children were at risk to apply for residency, not a court order.
Now my problem is this, I am not sure I believe her. (I now have trust issues, I think) on looking around here, I see people who have been forced by social services to have there husband / partner move out of the family home over these allegations.
Does anyone have any advice or know who I would be best placed to contact to ask without opening the can of worms that is SS? or can anyone recommend a specialist sol in Child Protection / Family Law in Scotland?
I hate the fact that I feel controlled by my ex, I hate the fact that people may think I have doubts over my partner as I have agreed to my ex's demand (short term only) and I hate what this is doing to both my partner and my children.
Sorry to keep posting similar stories but i just don't seem to be getting anywhere at all with this.
