  • Sex Offender Register

    In the UK the Sex Offender Register is a database of records of those required to register with the Police under the Sexual Offences Act 2003.

    Sex offenders subject to the register the following details in person at a police station every 365 without fail. Failure to comply could result in a minimum imprisonment of up to 5 years.

    Name(s)
    Address
    National Insurance number
    Telephone (home and mobile)
    Employment
    Car details and registration

    If any of the above details change, then offenders must inform the Police within 72 hours of any changes taking place.
    If you have spent any 7 days or more away from your home address in the past year, you will be expected to give them the dates, times and location. This means if you spend one day a month away from home, then it's easy to rack up that amount. It does not have to be one consecutive week, ie 7 straight days.

    There is also a requirement to inform the police of any planned foreign travel of 3 days or more. The police require a minimum of 24 hours' notice.

    Finally, the period of time you are on the Sex Offender Register is governed by the length of sentence received.
    A Caution - 2 years' requirement to comply with the Sex Offender Register
    Sentence of 6 months or less - 5 years' requirement to comply with the Sex Offender Register
    Sentence of 6-30 months - 10 years' requirement to comply with the Sex Offender Register
    Sentence of 30 months or more - Lifelong requirement to comply with the Sex Offender Register

    In addition to the Sex Offender Register, be aware that you will be subject to further restrictions as an ex-prisoner, such as a lifelong ban on holding, using or possessing firearms, imitation firearms, explosives, fireworks and party poppers. Yes, you read it correctly. Party Poppers are actually classed as explosives, and you really wouldn't want to risk 5 years for using party poppers!

    What sentences are given out to people who breach the sor requirements. ie. a minor breach like acouple of days late registering for instance, or going on holiday and forgetting to inform them?

    If an offender fails to comply with the notification requirements of the Act, or gives false information, he commits an offence. Such offences are triable either way and are punishable:
    • on summary conviction 6 months imprisonment or a fine not exceeding the statutory maximum;
    • on indictment imprisonment not exceeding 5 years: s.91

      If you entered or were seeking employment after a sentence would your employer then need to know you were on the SOR?

      Yes. You have to disclose it to employers and potential employers, and failing to do so carries a potential 5 year sentence. As do most of the other requirements of the SOR.
