  • criminal injuries compensation

    20 years ago my father was convicted of sexual assault against a minor and received 2 years conditional discharge and a fine. I was awarded criminal injuries compensation for this at the time.
    Its 20 years on and i would like to know if i can reclaim for compensation through the criminal injuries board again for psychological trauma as i am still receiving treatment for this now?
    I am not using what happened as a reason to gain financially but i have been advised that i can reclaim and i'd like to know if its true before i pursue it.

    Welcome to the forum. As you are still dealing with the after effects of this trauma, then we will endeavor to offer you as much support as possible.
    There are members here who have gone through similar ordeals and may be able to offer you assurance, understanding and support.

    As for your question about reclaiming compensation, I honestly can say that I have never heard of this before. It would surprise me if it were true that you could claim compensation twice for the same event but that's not to say it isn't true.
    Who advised you of this?
    perhaps another member may have experience of this and can offer you some advice.

      Just looking at the CICA guidelines...

      Can anyone claim criminal injury compensation from the CICA?
      There are a number of factors that could see your claim for criminal compensation refused. These include:

      Applying for the same injuries twice
      The incident took place outside of the UK (England, Scotland or Wales)
      Your behaviour provoked the incident
      You hold a violent criminal record
      You have failed to co-operate with police enquiries
      You delayed informing the police
      You did not seek medical attention following the incident

      Also one of the conditions is that you must make a claim for criminal injuries within 2 years of the assault usually. As it is now 20 years ago, I would be doubtful you could claim now...

        Hey,
        thank you to both replies. I have decided to not pursue this anymore. It was and never has been about the money. I need to get my head straight. I now have a psychiatric appt for next week. I'm hoping this will be the 1st step towards me finally putting this to rest and moving on with my life. I think i've allowed it to dominate me for far too long now.

          Well done for taking the step to attend some therapy. It will be a long journey but think about what you have come through...you can beat this.

            Germany removed financial compensation for those alleging rape as the system was being abused by people making false allegations for financial gain. They substituted it with top notch therapy. I had therapy years ago and although it was good it was certainly not what I call 'top notch'. I am sure I would have had a much happier life had I been able to access such 'top notch' therapy.

            I know people who have been through that horrendous experience who would never apply for it in any event as they felt they were being 'paid for' the rape. Some of them are on this site.

            Well done for seeking help. I had group and one-to-one therapy which was really helpful. That was back in the 1980's. I am sure it is much better than it was, now.

              Don't take this as gospel, I may have been misinformed but I was told by someone at the CICA that if I was later to be diagnosed with a more enduring condition (I have since been diagnosed with PTSD, but I still haven't accepted any money, it's too traumatic, oh the irony!) that I could submit an updated claim with evidence of the condition(s), relating to the original crime, that I now suffer from. I would ring them. You need to remember that you will be judged on the same rules they had at the time though and the rules probably have changed in the last 20 years so my advice would be to ring them and speak to them.

                I'd just like to say thank you for taking the time to reply. I have started on my therapy...only to be told it lasts 8 weeks (ha ha ha ..sorry i shouldn't laugh but it is laughable! )....they are going to see what specialist help is available out there. I'm hoping it will be a little more productive than the current arrangement. Still, i can't complain...any help is better than no help at all i suppose. I just wish this had all been done a lot of years ago instead of it being 20 yrs plus on.

                  Thank you for this information...i'm still undecided as to whether i really want to pursue this...but i will discuss the matter with my therapist. It's appreciated that you posted this though. Thank you.
