  • What can i do from here?

    Today i received a phone call from the police saying that the CPS would not be taking my case to court as their was no evidence to prosecute.

    I have been through hell and i don't think the woman who falsely accused me should get away without any kind of legal reprimand.

    What are my options?
    Can i sue? My solicitor mentioned that i could sue her for "malicious....." i forget the second word he used.

    Also, am i right in thinking that my arrest stays on some kind of file or am i totally cleared and all fingerprints/swab tests etc destroyed?

    Good news but ofcourse of little comfort after youve been through so much already but its positive and could have been so much worse !!

    Sorry but all your details will be held - like DNA, they will just wait until they get another chance I guess. So called second crack at the cherry.

      I'm pleased that you were NFA'd.

      You could try making a complaint against her, but I don't think they'd try very hard.

      FG is right, this false charge will appear each time you need a CRB check and also your details will be held in the DNA base.

      There is ongoing talks about those deemed innocent of any crime will have their details remnoved, but I wouldn't hold your breath.
      And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..

        The best advice I got was from one of the Police involved, he said to me most of his friends had left the country, I would like to hope one day I can follow them !!!

        This country is simply not fit for purpose and we all already know those who rule us aren't so is it ant wonder it's in the mess it is?

          Before we get into a political debate (FG!) let's deal with the subject in hand.

          First of all you need to contact the CPS in your area and ask if the reason they dropped the case was because either a) there was not "enough evidence" or b) if they caught her out in lies.

          If it's b) then you can request that they prosecute her for perverting the course of justice.

          I think that if you tried to prosecute her for malicious prosecution then you might have to pay an awful lot of money upfront unless you can find a solicitor who can help you out with that using public funding.

          If it's a) then nothing will happen and as has been said to you, there will be a marker on your record now.

            Oh RF I wasnt starting a political debate, I just find this whole thing one big joke, after all how many times does one have to prove their a liar? Ofcourse then its down to your defence - or not.

            AFter all some of us would argue the Police/CPS arent interested in the lies, to the point they puposefully delete them out and your defence then ignore them completely !!

            We all just have to accept if your face dont fit or the accusers know the right people to contact - your probably screwed.
