family accused of rape by girlfriend of 2 years

brother accused of rape by his former girlfriend, i was prosecution witness and was later dropped as a witness on the last day before the trial started, later use as defence witness during the trial

trial lasted for few days and at the end they were not able to find him guilty and the prosecution lawyer asked for re trial which will be a later 3 months, even though he has already spent 5 months in custody.

original bail application was rejected because they court fear that he would contact the accuser, even though an address outside 2 boroughs was given with tag and surity£.

A retrial is a retrial. The same procedure is followed. The first day or morning will be taken up with legal arguments probably relating to admissibility of evidence, whether there have been any abuses of process (police withholding stuff) and other pre trial matters.

The Crown will open. Complainant will give evidence. She will be cross-examined by defence barrister. She may be examined by Crown. More witnesses will go through the same procedure.

Defendant will hopefully give evidence with cross-examination etc.

Crown will make their final speech. Defence will close. Judge will sum up the evidence. The jury go out.
