my son has been arrested this morning accused of rapeing a woman who lies in flat underneath his flat please can anyone help me on the procedure of what will happen now would be very greatful on some advice

hi there thank you for your reply has of yet i do not know what he is pleading i have to be at the police station at 1pm uk time has he needs a apropeat adult with him for the interview has he has got learning and behaveral problems i know that they will be takeing swabs ect from him this afternoon but untill iv been to police station i cannot say much more sorry

If your lad is intending to plead not guilty and if you are likely to be giving evidence at trial, I would strongly suggest that you find another trusted "appropriate adult" otherwise the police will use your presence in the interview as a valid reason for you not to help your lad by giving evidence.

well i think i need to be there with him this afternoon but there is quite a few people who will stand up for him in court and defend him if needed be and yes of course has soon has i get back from the police station i will get back to you and let you know what was said ok thank you very much for your support

Are you likely to be a material witness to this case? Were you around immediately before, during and after the alleged assault?

If you were, and the assault is denied, then this will go one of two ways - it will be NFA'd (No Further Action'd) or it will go to trial.

If it goes to trial and you are a material witness, but you sit in on the interview, you will not be allowed to give material evidence. There might well be a multitude of character witnesses but if you are a material witness, your evidence could be vital to the defence case.

Is there anybody else who your lad really trusts who could sit in on this interview - just in case it goes to trial? You could still go with him and wait in the police station for him.

Obviously it is up to you what you do. However you need to look further down the line if what you might tell a jury could be the difference between a guilty and a not guilty verdict.

i dont know when or where the alegations was supposed to have happend we only see our son for a couple of hours in the morning when he comes down to see me and his mum has he has got his own flat and our son is very weary of people which is why i am going on the interview i will let you know when i get back ok has im about to leave now and try and get to speak to the soliceter before we go into the interview
