Falsely accused of chid rape

Hi,
I wonder if someone can help. A friend of mine use to live in the state was extradited by the police of UK. He is being accused of rape. He waived his right and decided to come to UK to clear is name thinking it will only take UK authorities 48hrs to bring him to Britain. Anyway, he ended up in the prison for 2 months before he was finally brought to UK. Getting here his bail has been refused due to the nature of the allegation. This involves a child. We were told that this happened when my friend was going out with the child?s mother. They lived together for almost ten years but after he decided to live them the mother is accusing him of raping her daughter. They?ve got the child and mother's statement but they never took any statement from him.
I do not know what to do could someone help pls.

All I can say to you is your friend has the fight of his life ahead of him. He will also be offered a plea bargain like my son did. This girl will be showered with attention and she will thrive on it. You need to find out how old she is and hopefully 2 young to have had sex or use tampons. Hopefully you can prove she is still a virgin. Good luck to you both, you need it x

Hello misery while i can understand your position, all you can really do to help your friend is to make sure that he has a good solicitor, if he really is innocent then there will be no evidence to prove that he has done the crime, it also depends on what the mother and daughter have said, I can assure you that in cases where a child is involved no stone will be left unturned, your friend has nothing to worry about if he is innocent, for example he can provide an alibi if he is innocent, and forensics will not be able to prove anything if he is innocent, so make sure he has a good solicitor and then let things take there course, if he is innocent, then the lack of evidence will show this, so therefore he has nothing to worry about if he is innocent.

Snoopyseed I cant believe how naive your comments are. Of course he has everything to worry about, convictions in this type of offence rely purely on the prosecution adding further bias to a jury already indoctrinated and prejudiced by media and paranoia over paedophilia Unless you can prove your innocence beyond any doubt you dont stand an earthly. That's fact. If you are on legal aid then it's unlikely the solicitor who is paid on a fixed rate is going to spend more than they have to, to get the evidence needed to clear you. You have to do this yourself. The prosecution know this and is the reason so many are unnecessarily remanded in custody where trying to establish your defence with minimal access to your solicitor is nigh impossible.

I agree with Towermouse. I am dealing with appeals against conviction where there has been no evidence and it's turned on the word of the accuser v the accused. Additionally virginity, in law, does not prove that rape had not occured. I recently dealt with one case where the accuser said it penetrated "1/2 centimetre" - this was enough to convict on rape and he's got 12 years for this one alleged offence.

In law, sexual intercourse (or rape&#33 only a simple pentration, no matter how slight, has to be proven. Before we all leap up and say "it's not proven, it's just the word of the accuser", if the jury choose to believe the accuser, then it is considered proven.

Absolute rubbish of course but that is how British Justice deals with these cases.
