Sorry about posting this on a seperate thread but I couldnt reply to the old one.

My son was told that the case would most likely be NFA. The girl has made 3 other claims of assualt in the past against other boys.

I think the DNA question may relate to the fact my son gave swabs from inside his mouth, I am not sure if that is standard practise when you are arrested or connected with the case.

The even happend at a rock concert and the police were already present, after my son rebuffed her when discovering her age, the police got involved and arrested him.

I feel sick, thinking about it. He wants to keep it from his grandma but as we live in the same road and see her every day (plus she is my best friend) it makes it hard to keep this to ourselves.

If she has been known to make several false allegations of this nature before then she should be named and shamed - pity she's too young to do that.

Prisons are full to overflowing - it's no wonder is it?!

Yes, its so frustrating. What makes it worse, is there are genuine assaults and people who are raped and these cases make it so much harder for them to decided which are genuine and which are not.

Is the sort of sexual assault my son is accused of likely to result in a prison term if he gets charged and convicted? The only information I can find about sentencing for sexual assault relates to penatrative assault...which this isnt.

It depends on what else the accuser comes up with (which may also not be true of course). He will be told by his barrister (if it gets that far - it may well not of course) that he would do well to plead guilty in order to get a shorter or even a non-custodial sentence. However, if he does that, and he is innocent, he will have no chance in the future to appeal the conviction(s).

Sorry to sound so grim but you really need to know what the worst case scenario could be.
