Urgent! My brother has been accused of date rape

My brother is being accused of penetrating his "girlfriend/friend" while she was passed out beside him. They fooled around in the shower, then in bed, she then claims that she passed out only to wake to him penetrating her without permission. She talked to a detective that will next be questioning my brother today. He is ready and anxious to tell his side of the story.
