    hi,what an impressive site!

    ive been with my partner for nearly 10 years,and am now caught up in a rape trial which my daughter has accused him off,i believe hes innocent and feel as if im getting nowhere,i have things like photos timesheet book and other little things which i feel may help him but the police are not interested,i worry that i wont beable to produce these in court i was questioned and told that i wasnt making a statement,however because my head was in such a not i signed and later learned it is in fact a statement,ive been told i dont need a solicitor and prosecution have called me up against him,im not even allowed contact with him until after the trial im totally confused mixed up but put on a strong front,im recieving councilling in the meantime my income has plummeted just scraping by and i live in a zombie state,ive been a victim myself and know the signs of abuse and havnt noticed any in her,shes very convincing and ive had trouble knowing when shes lying in the past only for her to admit years later,what do i do where do i go im lost and hurting.

    "There is no property in a witness".

    Police do not own you. I have no doubt that your "statement" will mysteriously be dropped if it is of no help to the prosecution. The statement will probably end up in what is called "the unused bundle".

    There is nothing to stop you contacting the defence solicitor explaining that you feel you were conned into making a prosecution statement. He or she might have to call you as a hostile witness but just so long as you tell the truth then you might help the defence case.

    Are you now separated from your partner as you cannot have contact with him?

    From my own experience I would advise against giving anything that might assist the defence to the police. It might "get lost" or they might say they never received it - that happened in the very first case I was involved with. Send it to the defence solicitor with a note saying you would like to help the defence case but you are now a prosecution witness. As I said before it is likely you will be dropped at the last minute thereby depriving your partner of a potential principal witness.

    Let the defence know you would like to be called even though you are are prosecution witness.

      thankyou rights fighter for your reply,its a huge help as ive tried everywhere and failed to get a response,il follow your advice,just 5 weeks to go until the case begins im absolutly scared,never thought this would happen to me and found it shocking how frequent these cases occur,goodluck to all going through it councilling has helped me get back in to work and a little normality in my life a 7 month long nightmare,cant wait forit to end but whatever the outcome its a tough future ahead.

          Hi i no what you are saying i am married and my wife has two kids who have both said i raped them !they kicked house door in on friday the 13/07/07 and ransacked the house then remanded me ! was scary stuff crown judge gave me bail and am still fighting it now the wife is standing by me. hope you get it sorted

            Hi to both of you - may I suggest that you both join www.pafaa.org.uk . You'll find many more people there that are going, or have been through this nightmare.
            And God promised men that good and obedient wives would be found in all corners of the world. Then made the world round .... and laughed and laughed and laughed ..
