    Hi everyone, I really don’t know where to start as I have never been anywhere close to a situation where someone is wrongly accused of rape. My younger brother (black), 24 years, old, he is a student of Bolton University and he’s married, he has been falsely accused of rape.

    He went out on a Friday night with his friends and while they sat on a table drinking a girl came over to them and said she like one of his other friends and that she would want to kiss him, apparently this guy she is determined to kiss is known for doing drugs (unknown to my brother) and probably have sold drugs to her in the past, However, this guy declined, saying he is not interested, she tried to get on with the rest of the guys but all refused except for my brother, at some point, they went up to the smoking area and from there they went home to his place, they had sex and the next morning the police barged into his house got him arrested that the girl he slept with last night has accused him of rape.

    My brothers is so naïve and weak in the heart, he probably felt for the girl after everyone has turned her down and decide to get on with her and now he is in trouble. He has been refused bail at the magistrate court because the judge thought that since he is not a UK citizen, he might leave the country, the duty lawyer in charge of the case filled in an appeal for bail at the crown court, the judge has requested for evidence that he is a student, he is married and also has a job, b4 he could assess his bail application.

    I need some solid advice on what to do; I am his only relation in this country, I know the police from experience that they would be every happy to do anything to make sure he is found guilty, after all, he is black, a foreigner and lives in Bolton

    Thank you for your PM to me at PAFAA. I now see what the problem is. I thought this matter was based in a different area due to where you said you are. Am I right in thinking that you need a solicitor from around the Bolton are then?

    Re witnesses: you need to find out who those guys were that she came on to and make sure that they contact the defence solicitor. Do NOT tell the police about them as they will use them as "witnesses for the prosecution" and then mysteriously drop them right at the last minute, so defence can't use them.

      I don't really care where the lawyer comes from, so long he is an expert in cases like this, i would go with him. The present duty solicitor don't seem to really care, he couldn't present his case convincingly before the magistrate court to grant my brother bail and when i asked him the reasons why bail was rejected he said, the judge thought he might leave the country, so he suggested that my brother would hand in his travel document and report to the police from time to time but still the judge refused. OK, he then appealed for bail at the crown court and then , the judge requested for evidence that he is a student, he is married and has a job, b4 he could assess his bail application. If he was a smart lawyer he would have anticipated that the judge would require more evidence in order to grant him bail after being rejected bail at the magistrate court. Now if he can't foresee these little things how then can he defend the case. I REALLY need a proffessional lawyer, a lawyer that has way with words, because as things stands, is a case of one persons word against another.

      I have spoken to one of the guys that were there, he told me that, my brother told him the next day that he had sex twice with her, the first time they came home, they had sex and she then she realised that she forgot her jacket at the club, they took a taxi back to the club and then came back again and had sex again b4 she then left in the morning. The one thing that puzzles me is why would she then go ahead and accuse him of rape, for what gain, what might she want, why do SOME women do such things like this. I have read a lot of post on this forum and my God, it is happening to many people out there, there must be some kind of awareness as until now, i never knew such thing still exist in this modern times. I have seen it on TV but never thought it does happen to commoners.Well, my idea is to create some kind of awareness through music. I am a songwriter and a local rap singer, if there is any one out there that is ready to partnership with my idea, we could seek support from some where and use music to remind people out there to be careful as there are SOME women whom are hell bent on bringing men to destruction. These kind of women have no conscience and the things they do are only natural to them so they don't see it as any big deal. I have also found out that most of these cases starts from a night club, so if all the DJ's in the UK play a song twice every night, one at the start of the night and one at the end, then innocent young adults will be aware and when these kind of women comes by with their scheme, the innocent ones would be on their guard and play safe. What do you all think?

        I've emailed you about the lawyer. I have emailed the guy I work for to ask if he will take this trial on. He is in the NW but not sure whether Bolton is too far. It it is I know of a good solicitor's practice in Middlesborough and also in Durham. I'll look for one nearer to your brother but in the meantime let's wait to see what the sol I have emailed says.

        You'll need to speak to all the people who were around (that you know) who will be willing to give evidence for defence. Don't let your brother give Plod their details as they will then turn them into Prosecution witnesses which means your brother can't talk to them. #they will then be mysteriously dropped at trial - too late for defence to use.

              It's the solicitor who is the superstar. Apparently public funding is now so low for defence cases that it no longer makes it financially viable for a solicitor to actually take conduct of any trial matter unless they are very local and straightforward. The instant matter is not "local" but is apparently a straightforward matter so he's taken it on.

              Chris is a diligent and thorough solicitor who will put all he has into it. Contrary to popular opinion criminal defence solicitors don't get paid much unless they are privately funded. Those cases are very few and far in-between.

              At least SU4YR has a solicitor who is highly experienced in these matters. thank the Lord!

                  I know - although some solicitors will do their very best for the client regardless of how much they are paid where others only spring to attention when they have several thousand pounds thrown at them.

                    Thanks RightFighter for helping! I am so grateful, at least now, i feel confident knowing that a competent lawyer is taking over the case.Also, i heard that this particular girl has falsely accused loads of guys of rape, most of the cases get dropped but what i don't understand is why does she keep on doing this, she must be getting something from it. I now know her name but i can't post it on this forum due to, you know, you know. Is it possible to check some kind of database to check on her, i can email her name to you if you want.

                      I have PM'd you about this. If you can provide evidence that this girl has told similar lies before you will need to let Chris know asap and give him as much details as possible about this so he can use it.

                        Soz, about your brother. RF has that aspect in well in hand.

                        I'm interested in your music Idea. I'm sure you are aware that loads of musicians are promoting their music with free downloads through the social website 'myspace'.

                        I get three or four a day wanting to add to my GAY RIGHTS profile. (We only add those with a clear LGBT messege or content due to the sheer number we were recieving)

                        I REALLY think promoting an awareness messege through music is a good idea...look at Billy Holidays 'Strange fruit hanging from the poplar trees'
                        and the blues messege that got across (even to a white homosexual guy like me) about Black civil rights abuses in the American South.


                        So many young people use the social website myspace and they are a primary target audience for this messege! Set up a profile, promo your music. You might also think of using YOUTUBE for promoting the messege too along with your unique music. No copyright issues then,...brill.

                        I use YOUTUBE...over 100,000 views have been made on my 'youtube' video channel concerning and raising awareness of HATE CRIME, & police Homophobia!
