  • Husband falsely accused

    My husband was the executer of his late mothers estate, when we went to Ireland to buy a head stone for his mother. His sister fraudulently sold her house and his brother put his name to the plot and we haven't been able to put the grave stone up. we had been to the law society and found out they sold the house without a lawyer, the woman who owns the house now told us it was his sister who sold the house to her. Since then, my husband was pulled into police for questioning on charges of historical sexual abuse on his sister, niece and other friends of theirs in 2017. These are all allegations and they have no proof. Since then my husband had to go to high court in from 1st May until 14th May to hear all the witnesses tell a pack of lies about him, I managed to go a witness as a witness but unfortunately the jury wouldn't believe us about his mothers estate. We have all evidence about where my husband was in the 1980's and 1990's, also he has passports from before in the 1960's and 1970's, his mothers will and the picture of the gravestone sitting in our house but the advocates and judge wouldn't allow us to put them over, so the jury found him guilty. Now he is charged with 11 charges consisting of rape, sexual assault and libidinous practices, he has been remanded in custody at Barlinnie and is up for sentencing on 11th June. I am going out of my mind with worry as he is a 73 year old disabled pensioner who is in very bad health.
    I have been in touch with MOJO Miscarriage of Justice Organisation. I hope to find him a better lawyer than the one we have as he wouldn't let John put his evidence over, if you can suggest a good lawyer who specialises in sexual allegations and how to appeal would be much appreciated.

    I'm very sorry to hear of your troubles Cherry,

    I'm not aware of any lawyer in Ireland that is recommended here except one in Northern Ireland but i hope that some researching and calling round will point you in the direction of a good one.

    Please take some reassurance from the fact that a prosecution can all too often have a myopic view and that a full defence presented in court often has a positive outcome.

    "proof" in these kind of cases is often difficult as you surmise and what is important is that there is "reasonable doubt" about guilt - the trick is often to be reasonable - in your defence case, the background of the inheritance is not proof of a false allegation but can hopefully go toward showing a reasonable doubt.
