    HI everyone

    Last october an allegation was made against me, by a previous partner.

    They alleged I had raped them on two occasions.

    The case recieved an NFA in December, but I still don't have my mobile phone.

    I felt like my world is still incomplete without this. I voluntarily handed it over, but now it seems that I am unable to get it back.

    Hello and welcome DM Train,

    I'm glad that your case was NFA'd but appreciate that mobiles are expensive.

    Have you asked the officer in the case (OIC ) if you can have it back? A polite request rather than a demand often works, simply tell them that you would like it back because you can't afford to replace it, make some obliging noises about you recognising that they are busy but please when they have the time......

    If this fails ( or has already ) then you can complain via their superior officer or professional standards dept - the details for which should be on the forces website.

    They are not allowed to keep your property forever, they have a "reasonable" amount of time to examine it as stated in the police and criminal evidence act (PACE ) - Sorry I have lost the bookmark to the appropriate section but google should find it

    Perhaps your solicitor could help ?

      This sounds like an idea. I will get in contact with my solicitor.

      I know they are busy and the Investigating officer is a great help; as I can just email him.

      But, its getting to the point where I handed it over, and I am becoming slightly annoyed at how slow they are giving it back.
