Need some advice 2 years after nfa

Hi peeps. I was a active member of this forum when I was falsly accused in 2016 and I was Nfa. Now to my question. How and can I get my arrest/DNA and details removed from the police database? I have recently applied for my firearms certificate and during my licensing interview my arrest was brought up in a very harsh way. I was told that because of my arrest even though I was not charged and nfa I probably won't get it granted even though I was a certificate holder before the false aligation.

Two years have passed and I am trying to get my life back together I have been seeing a therapist and receiving CBT to deal with the ordeal. Now today it has been dragged up again

In order to get your dna, finger prints etc deleted from the national database you have to request it to be done via the Chief Constable of the force that arrested you. It is treated as their property and they have control. They however will reject you application if you have been found guilty of an offence prior or post the nfa. In my area you also have to to wait three years after the arrest before you can ask for it to be removed.

Your arrest will always be on your record. The police keep accusation and arrest records forever, they call this soft intelligence. So no matter what it will always be there when they check you for your gun licence.

I'm sorry to hear this is rearing it's ugly head for you.

I can't give you any really good news sadly.

As far as I know, your biometric data (DNA, fingerprints) will have been deleted when you were NFA'd. ( unless you have previous convictions )

However, your arrest will stay on the PNC unless you have proof beyond a reasonable doubt that you were innocent.

I have no clue about firearms licenses but I would say the fact that you had one before would go in your favour, I would imagine there is an appeal process if you are turned down. I guess it depends on the accusations against you, if violence was alleged this wouldn't help for example.

I can only suggest you have a word with a solicitor.

Thank you for your replies. I have never been violent or had any other arrests. I will have to just wait and see what happens. Thank you again for your help.

I'm sorry to hear this. We haven't got to the point you are yet but have been told that getting the licence back should be no issue if NFA'd or found not guilty. Ss Peter1975 says, have a chat with a solicitor. You could be up against someone's personal prejudice rather than someone who knows and applies the 'rules'.
