  • Is case still open after NFA but before VRR is complete?

    We've had individuals connected with the FA contacting us to say that the case is still ongoing because she's put in for a VRR so in their eyes my partner is still "guilty" and she still has a right to call herself his "victim" forever and ever regardless of anything the stupid CPS may say.

    And does anyone know please how long this VRR is going to take?

    Rightsfighter do you mind if I send you a PM with some background which I don't want to put here as you may be able to give better advice if you know what's been going on - its quite an unusual case and allegations are nasty

    Some people will insist that all vegetables are blue and because they say so it must be true. It's horrible to have to live with such nonsense but you and your partner know the truth.

    Remember, these people's opinions are meaningless and you are not obliged to allow them to contact you.

                I'm breaking

                She's put in for an independent review of the VRR(whey the hell do they call it a "victim's" right to review - shes no victim she's just a liar) - no one can give us a time scale... just "indefinite" . CPS website says 6 weeks with caveat that "sensitive or complex cases" (which no doubt this is) will not be dealt with inside that timescale

                I hoped this would end with the NFA... how bl**dy wrong was I?

                Feel sick... was just about starting to recover my mental health now this... actually lay sobbing on the kitchen floor yesterday and got covered in snot... why is this "person" trying to break my partner and my family and ruin my children's lives. Feel like I can't go on being strong and supportive... but i need to

                I can't cope with another 2 1/2 years or however long the CPS decide to take of this... I just can't... I need this to finish...I need this to be over.... I'm broken and I don't know how my partner is going on... and I can't tell him I'm like this I'm trying to be normal for him and its hard.. and I'm whinging here...

                Sorry I know lots of people here have been through far worse and i don't know how you've all remained so calm and strong. My 100% belief in my partners innocence helps of course but what if some bureaucrat or other suddenly decides to push onwards...

                  I understand your frustration at the situation and the use of the V word, perhaps the dimwits have trouble spelling "complainant".

                  I hope the CPS can pull their fingers out and make the right decision quickly, I can't see it taking as long as you have already waited.

                  I cannot give you false hope, I am aware of cases that were NFA'd and stayed NFA'd after review but I also know of some where the decision not to charge has been reversed. I imagine sometimes where the "victim" is a pain, the cps are afraid of saying no so it is passed down to the line to someone that will say yes.

                  No matter what the decision eventually is, the VRR does not change the weakness or paucity of the evidence and neither does it remove the doubts that the original CPS lawyer had about a reasonable prospect of a conviction which a good solicitor will be able to exploit.

                  Please try not to worry about what may happen until you find out and just deal with each stage as it comes. I promise that you are stronger than you need to be even if sometimes you have a wobble, just be kind to yourselves when you are feeling low and make the most of the days when you feel like you can take on the world.

                  On a slightly gloomier note and for the benefit of those that read rather than post, a NFA can always become an active investigation if "fresh evidence" is presented so you should keep all paperwork, screenshots, texts, emails, photo's etc that you may have gathered in a drawer somewhere just in case. You can also make a subject access request under the data protection act to your police forces legal department who will be obliged to provide all information they hold about the person making the request including police pocket notebook entries, CRIS (crime reporting information system) entries (incident log), records of 999 or other calls, radio chatter, and police station CCTV.

                    I've nothing to add to Peter1975's excellent advice but just wanted to add - don't be fooled. Having a wobble, a whinge and getting all snotty is par for the course. Don't make the mistake of thinking that we are all as strong as oxen here. We have our moments. It's normal, par for the course and why we are here - so that those in their strong moments can support those in their weak moments. It's a fluctuating position and we are all stronger than we think. Wobbles make us forget that.

                    Don't be afraid or ashamed of having a wobble. We all do.

                      Thank you both for taking the time to reply and most of all for not insulting my intelligence and telling me "oh sweetheart everything will be alright". You've been balanced and honest and actually made me feel better and reassured. Whilst I lay in despair on the kitchen floor it never even crossed my mind that the opinion of the first CPS decision maker actually holds weight whatever happens at a later stage.

                      I am worried that the CPS may decided to pass it on to the courts just to get this False Accuser off their backs but each day, week, month and possibly year as it comes

                      Feeling a lot more human today... thank you so much

                          RF is absolutely correct as usual and I should have made that clearer. The person making the request is only entitled to information about them, they have no right to anyone else's data. You are certainly not allowed an accuser's statement unless there is a charge. There is also discretion in what can be disclosed while an investigation is ongoing come to think of it but i wouldn't expect police station cctv to still be available at the end of an investigation.

                          The only reason I mention it was really to emphasise that those NFA'd should gather and keep as much information as possible as a precaution, put it at the back of a drawer and then forget about it.
