Bail question, opinion needed

    Hi again. I talked to my solicitor and told him about what Peter had said re: not putting people on bail as a 'neat way of getting around the new laws' and he just said , that was true, but that the new law did not apply in my case , I did not understand why it would not apply , think he may have said why, but I never fully understood why. Can anyone think of a reason that it does not apply in every case? I 'think' he said something about structure or something, he did not say it was because my case was started before the new law came in, as that was what I thought might be a reason, but its not

    Do you know the reasons that some cases do not apply to the new law on cases not kept on bail for more than 6 months.?...its nearly a year since the alleged rape, and I am still currently not on bail, although I was for 2 lots of 3 months ....I'm just hoping this is a good sign, the waiting though is so hard

      If in doubt with what you solicitor told you, ask him to put it in writing.

      Most of your questions should really be answered by them. If you do not trust their advice, or are having second thoughts, find an alternative.

        The new law does not apply in your case because you were arrested prior to the law coming into effect in April. I imagine that unbailing you is just bringing your case into line with new force policy and probably saves them extra paperwork or having you turn up at the station to answer bail and them apparently having forgotten all about you!

        It really makes no difference to your or any other case or how long it will take them to investigate. The law was not designed to speed up investigations, or if it was it wasn't thought through.
