  • In Support Of All Those Falsely Accussed And Wrongly Convicted

    Hello everyone

    Please could you sign my petition to parliament by using the link below, if you agree with the content. If you could also forward the link to as many people as possible it would be greatly appreciated.

    I feel the law needs to be changed to help the falsely accused and wrongfully convicted who have committed no crimes but are serving lengthy sentences in prison nonetheless. At least 200 signatures are required for the government to take notice of my petition there are 59 signatures to date but the more the better.

            A TEENAGE girl who made a false accusation of rape has been prosecuted and could be jailed.
            Seonad Campbell (18) told police a taxi driver had raped her after he drove her home from a night out in Pontefract, just three weeks after her 18th birthday.
            Miss Campbell (pictured, right) reported the claim to Humberside Police, causing two men to be locked up and questioned for eight hours and five hours in July and August this year.
            The first was wrongly identified as driving her home. The second taxi driver had not raped her, but had recorded their exchange on his mobile telephone.
            Miss Campbell, of Lidgate, East Cowick, was treated as a rape victim initially. But as details emerged of what had really gone on the tables were turned and she was interviewed and charged.
            The men went through their own ordeal of having to explain to friends why it was the police were interested in them.
            Miss Campbell turned 18 in May and made three appearances at Hull Crown Court before finally pleading guilty to a charge of doing an act tending to pervert the course of justice last Friday, November 30.
            Supported by her father in the public gallery Miss Campbell, dressed smartly in a suit, spoke only to plead guilty to the charge as it was put to her in the dock of court three. The man she accused of rape was not in court to see her plead guilty.
            Her barrister Anil Murray had told previous hearings he wanted to see the statements she had made to police and the taxi driver's video of events to see if she had a legitimate defence that what had happened was her "best recollection".
            He said in the latest hearing that Miss Campbell had no previous convictions and the court needed the benefit of a pre-sentence report before she could be sentenced.
            The Crown barrister did not open details of the case at this stage, which is normal.
            Judge David Tremberg ordered Miss Campbell to stand as he told her: "I am adjourning this case to allow the preparation of a pre-sentence report. By ordering the report and allowing you bail, I make no promises of the final sentence that will be imposed when you are finally sentenced, and that includes imprison-ment."
            Miss Campbell was allowed to walk free from court, but not before seeing a Humberside Probation Officer present in the building.

                  I would be willing to go to hell and back if there was a chance of getting him out. I'm not giving up fighting for him as I feel there is still hope but he is very pessimistic- understandably so. I will be visitng him soon so I'm hoping to give him some renewed hope and encouragement.

                    Thank you for your e-petition asking for the above change to be made to the criminal justice system, so that convicted sex offenders on indeterminate sentences, who claim to be innocent, should not have to admit their guilt nor participate in treatment programmes for sexual disorders before being considered for release. The Government's position is as follows.

                    All those people who are sentenced to imprisonment for public protection have been found guilty by a jury and to be dangerous by a judge. It is not correct to suggest that those who protest their innocence are automatically barred from consideration for release. The consideration that the independent Parole Board makes, in deciding whether or not to release an offender, is whether that person presents an unacceptable risk of serious harm to the public if released. In general, those who have undertaken work to address their offending behaviour will be better placed to persuade the Parole Board that their risk has reduced.

                    Some programmes are suitable only for offenders who admit their guilt as they involve work using the direct circumstances of the offence, but not all do so. In any event, the Parole Board releases some offenders who have maintained their innocence throughout. The Parole Board has done work in this area recently in conjunction with "Progressing Prisoners Maintaining Innocence", a voluntary group that looks to take forward the interests of such prisoners.

                      Sadly it sounds like a "Give some answer and forget about it" kind of reply, but we can only hope that it will stay with someone in authority and they may bear it in mind when they next look at the relevant legislation.

                        The recent government response to my petition gave me absolutely no hope that the man I love will ever be released from the indeterminate sentence he is currently serving... an innocent man incarcerated indefinitely for crimes that never even happened. The government will just not admit that a miscarriage of justice has occured and have repeated the same old spiel which I anticipated... "All those people who are sentenced to imprisonment for public protection have been found guilty by a jury and to be dangerous by a judge."

                        Yes that statement is quite correct but does the government realise the shambolic scenario that goes on in the courts of this land? I was waiting to appear at the court to appear as defence witness for two hours and the defence barrister did not call me as he thought I would get "too emotional." even though I knew the real truth. The man I love had no adult witnesses. The only witness he had was my eleven year old son - and the judge said my son had been manipulated by him! The man I love was not allowed a fair trial -he had no proper defence. All the people who wanted to defend him were not allowed to be present on the grounds that there was no public funding. The trial was a complete shambles and travesty of justice and I felt powerless to defend him when I knew he was totally innocent.

                        The man I love was convicted by accusation and in a so called fair and just society it should not be possible for a defendant to be convicted purely on these grounds but sadly this can and does happen rather more frequently than most members of the British public care to realise. The Criminal Justice system is held in high regard by most UK citizens and is still viewed as one of the finest in the world but it is being abused by malicious liars who bring false allegations to court in much the same way as some people make fraudulent claims on their insurance. But in cases such as this, their monetary gain succeeds in destroying the lives of innocent people and causes them to be incarcerated indefinitely. This is exactly what has happened in the case of the man I love.

                        Currently in the UK our prisons are full to overflowing and the number of wrongly convicted prisoners need to be drastically reduced. There is very little opportunity for the innocent to overturn the decision of the courts and right the wrongs that have been done to them once their trial is over.

                        It should be made impossible for a person to be convicted when the only "Evidence" that an offence was actually committed is based on the accusations of others. But at present it is quite possible for juries to convict when there is no proper evidence such as a body in the case of a murder or DNA evidence in the case of a rape. The only "Proof" of the defendant's guilt is sometimes the lies and vindictive corroboration of people who bear grudges against the accused and are abusing the power of the state to convict an innocent citizen.

                        The jury only have to be convinced by the prosecution that the defendant is guilty and if they believe it "Beyond all reasonable doubt" then a conviction is guaranteed. The jury are more than willing to go along with the lies of many rather than the truth of few.

                        The British legal system can therefore be abused by blatant liars who know they can secure the conviction of a person purely by invented evidence. They get compensation for their false evidence - sometimes as much as twenty thousand GB pounds a piece and an innocent person is denied justice. The Criminal Injuries Compensation Authority will gladly pay out to these unscrupulous people who have borne false witness against their neighbours and perjured themselves in a court of law.

                        Judges in cases of this nature should be more willing to direct juries away from this absurd reasoning which would be better suited to a medieval witch hunt than a fair and reliable Criminal Justice System that we should be able to respect. The defendant should always be found not guilty when it is a case of accusation only. The Crown Prosecution Service, in bringing innocent people to justice are only succeeding in incurring further costs to the tax payer. It costs over thirty thousand pounds per annum to keep a prisoner imprisoned so the only people who benefit are the liars who have ruined the lives of upright citizens. Cases based on dubious evidence should not be allowed to proceed, thus avoiding expensive trials and depriving innocent people of their freedom.

                        Innocent people should never be deprived of their freedom... there are enough real criminals with which to fill our prisons. I have no hope that the man I love will ever be released. I said I would gladly go to hell and back if there was a chance of getting him out but nothing can be done now other than he prove to the parole board that he is no longer a threat to the public when he comes up for parole in another two and a half years. But how can he possibly do that when he was never any threat to begin with?

                              The reason that you have been told by PAFAA there is nothing that can be done to end this nightmare, is that your friend won't do anything about it.

                              I really did not want to answer this post but your reply implies that PAFAA is a "toothless tiger" when in fact it is not. If a defendant or inmate shows no interest in appealing this type of conviction, for whatever reason, then, with all the best will in the world, nobody can help them.

                              PAFAA is set up to help those who wish to be active in helping those protesting their innocence of sexual offences.
