I was arrested in November 2016 for allegation of rape on my partner which she then decided to withdraw cause she couldn't cope with our two little ones, I then went home for xmas, which was one of the best Christmas and new year we ever had and then the end of January we had a little argument to which I went to stay with my parents. Well 2 o'clock the next morning there was a knock on the door, the police saying they were arresting me on suspicion of rape again. I was interviewed and released on bail. Now the bail has been taken away but I'm still under investigation. My head is all over the place, is anyone in the same situation as myself. All my confidence has been sucked out of me and I feel like I'm going mad. How can women do this?

Sorry forgot to mention the first time was after an argument but was apparently 5 weeks before she made the allegation and the second time she said happens the day I went back after my bail but she only said about it after we argued end of January which was 6 weeks after

I am sorry to hear of your situation John.
I'm afraid you must wait this out with the standard advice of saving all evidence from texts and social media etc.You may wish to find a good legal team to have in place should charges be brought. While there is every chance that this will be NFA'd, advice here must be to prepare for the worst and hope for the best.
I'm sorry to tell you that there is not actually any concept of "retracting a statement", your FA could only offer up new information that her statement was false, risking a charge of wasting police time, or tell them that she was not prepared to be a witness in court. The third option for her would be to add to her statement, changing details to make her account unreliable but not incriminating her for PCJ. Either way, the original statement cannot be unmade and one could be used to bolster the other.

I've now been taken off bail but still under investigation how long does all this go on for, really can't take no more. Really stressing me out and feeling low, what does taken off bail and still under investigation mean is that a good thing or bad

The new police and crime bill comes into effect soon and among other measures, prevents the police from keeping someone on bail without good reason and an application to the courts. In anticipation of this, various police forces have begun releasing suspects from bail but continuing their investigation. I think it is supposed to put an end to endless rebails while the police apparently do nothing and make them hurry up but in effect they just cancel the bail and carry on regardless.
In other words, it's the same position but without formal conditions. It's neither good nor bad and is really just the same "limbo" stage that being under investigation always has been. You should be cautioned against any contact with the FA as although you cannot now be arrested for breaking your bail conditions, if she was to complain you could be arrested on suspicion of witness intimidation, the burden of proof would be on you to prove that it was not your intention to intimidate, even if you just said hello.

Been told that they waiting for my phone to come back. Does anyone know how long that takes please.
Just can't believe I get accused once then it gets NFA'd and then get accused again but they were both 5-6 weeks after it apparently happens and both after a argumentLast edited by John14; 14 March 2017, 12:50 PM.
