    This is actually good news, as this can form part of your evidence. The image is not consistent with the allegation; get a digital copy of the image, with the date - log it. See if there is anything else that might be used as evidence. Do deep searches and dig anything out that you can. I compiled a massive wad of evidence just from social media that went someway to detailing my FA's narcissistic personality disorder and other inconsistencies with the allegation. My friend, you have to fight - even if it just ends up being a mental fight that does not end up being taken to court. Stay strong, get up on your feet and start fighting back.



    You MUST get yourself a solicitor. I am sure if you ask Rights Fighter nicely she will be able to advice about a good local solicitor.

        I haven't been charged my bail date is in 5 weeks, I just want a solicitor to show all my evidence to and have a chat too as mine hasn't told me much it was all rushed at the station. How many of false allegations get charged and what does take for the police to just charge someone?

            To be honest, you are better off not showing anything to the OIC. Whatever evidence you have at the moment is best kept to yourself and quite honestly, you'll only know what helps and what doesn't if and when you are charged. Certainly, locate a decent solicitor with experience innfalse allegations and have a chat with them ahead of time if you want, but they wont be able to help you much with your individual case until you have sight of her statement and you only get so see that if and when you're charged.

            That said, the majority of these complaints dont get charged, so don't cross too many bridges til you get to them. Make notes on all you can remember relating to the accuser and the incident, screenshot anything relevant you see on social media but don't comment yourself and keep that information safe, locate a specialist solicitor - there's a stickied thread with recommendations on here - and then batten down the hatches for a wait.

            The best thing you can do at the moment, apart from the suggestions above, is keep yourself busy and try not to worry. It's not easy but worrying won't make anything happen any quicker.

              No. Don't share anything like that with the police. It can be used to correct a false impression in court but will make no difference to a charging decision and you would only risk giving the accuser a heads up.Better to ambush them in the witness box when they have to think of an answer on the spot.

              It won't hurt to seek out some advice from a solicitor, but there is no legal aid available for pre charge advice. Solicitors are paid a one off fee for police station advice and some will include a free follow up phone call but there is no incentive to waste their time listening to your evidence as they will not get paid anymore if there is no charge or you decide to change solicitor. At this stage it is possible for you to pay privately for additional advice and sols time but as RF says, you may be able to get advice here for free.

              Most false allegations do not get charged. Around 80% of all allegations are NFA'd. There is always hope. The odds are always in your favour and you can increase those odds with the right advice, legal team and support network.

              The only evidence that is required for a charge is a complainant's statement. While this might seem unfair and almost ridiculous, you don't have to look very far to find hundreds of examples where a witness's statement, sometimes decades after the event and with no corroborating evidence whatsoever, has resulted in not just a guilty plea but an apology and full confession. I'm afraid that this is simply the easiest area of the law to abuse with a horrible lie and always has been.

              FWW is right, try to keep busy and not drive yourself mad with all the what if's and questions that you won't get an answer for at the moment. Squonks advice to stalk social media and take screenshots is also excellent.

                I echo everyone else when saying absolutely not; these things make up your defence and you don't want to give her an advantage. She is lording it over you - ok. Work quietly, intelligently and covertly building your evidence base. While she lives it up - you work. And guess who will be more prepared in court if it comes to it? Exactly. You. During my near 7 months in the kind of position you are in now I worked every day either gathering evidence or researching the relevant legislation. You can take some control back in this way and it makes you feel a bit better - well, I found it did anyway. Just leaving everything to your solicitor when you get one is not a good idea. You hand the evidence to him/her, they can make something of it. Hiding and worrying and handing them nothing = zero use. Take advantage of the time. Panic will never help although of course it is natural. Just be careful not to contact your FA in anyway - stay well away. Also do not talk to potential witnesses as this could land you in hot water and could be a criminal offence in its' own right. Come back to the forum often.

                  Hi again youngscared.

                  Sorry to see you are going though this too. In response to your question I am down in the dumps also. However I'm getting back to every day life but cannot stop thinking about everything. I finally have got back to myself a bit, and managed to concentrate at work. I am also spend a lot of time in the gym and have finally got back to going there, although I get asked a lot. "Where have you been. We haven't seen you for ages". I can't tell anyone this so make up a story. I have put on a lot of weight from comfort eating and the first 2 weeks post accusation didn't leave the house.

                  I've probably read a lot of the posts on this forum. Read people's advice etc. There is great advice on this thread also so please listen to it and don't get down in the dumps too much. I have been seeing a counsellor and it has helped me .. so if you need please see one.

                  I've also don't a lot of reading on this topic which may not have helped me as it's no clearer! This happens a lot. I've read all about the lead case on intoxication and consent - Benjamin bree. Alison Saunders comments, cps rates etc. It all depends on what they decide.

                  In terms of next steps there is not much that can be done. I've asked my legal aid and got in touch with the solicitors that rights fighter has in their signature. They have said we have to wait and see if there is a charge really.

                  Everyday I hope that there will be a NFA in the best case. How perfect of a life I had before this and if it will ever be the same. Every night I have nightmares. One minute I am fine and then next i can be in tears. It's hell so you are not the only one.

                  Let's keep each other in the loop as we both have similar cases and bail dates.

                    It's been about 4 weeks since the weekend I was arrested and interviewed (no charge) and put on bail. What are people's thoughts on me calling up the station to see if there is an update on the case? They will probably say "gathering evidence"?

                    I know 4 weeks isn't a lot as I still have another 8 weeks bail on top. And I've read people are often charged or nfa MONTHS after. But I just want a bit of peace of mind

                      I know exactly how you feel, going through same thing.The end of November of last year me and my ex had an argument and she had me arrested, while I was in police custody a few hours later a officer came in and said I'm further arresting you on suspicion of rape, so I was interviewed and released on bail. While I was on bail my ex was constantly phoning my family saying she couldn't cope as we have two children, she then made a withdraw statement and there was no further action. I then went back just before Christmas and things were good, the best Christmas and new year. Then at the end of January had another argument and I went to my parents to stay for the night. At 2 o'clock the next morning my dad woke me up saying the police was here, they said they was arresting me on suspicion of rape again. When interviewed her statement sounded the same as the first one. I'm feeling really low and having trouble sleeping and eating. Feel like my life is going down the pan

                        Sure. Phone the OIC and ask for an update, but you are right, all they are obliged to tell you is that the investigation is ongoing.

                        Some cases have been NFA'd in as little as 4 weeks. Some have had bail dragged out for 2 years. It's the worst stage in many ways, I know how it feels and you just want the truth to prevail. It just takes so damn long. hang in there and try to remain positive, keep busy and hopefully there will be some common sense.

                            Currently 5am. Last few days I've been finding this really difficult. Trying to resume normal life with the bail over me and a potential charge. I just wish that night didn't happen as it will be with me the rest of my life now

                              All your experiences ever will be with you for the rest of your life. Don't lose sight of that. 5am can be a dark time in the day, physically and figuratively, but be patient, it will get easier to cope with.

                              I was looking at the click this morning at that time too, but it's become 'oh, a few hours to go before daybreak', and I get back to sleep quite quickly.

                                I have the same feeling bro, bail is in 4 weeks I'm absolutely dreading it. I'm completely innocent of this charge yet I feel if I hadn't of gone out that night things would be normal, I never imagined in my worst nightmare I could ever be in this position. I'm a well known popular lad in my hometown and it's common for the police to put people's name in the paper once charged.
                                I should be alright if this went to court as I feel I have a very strong side of evidence but it's just having to be known for being accused of rape. I never thought that one night out could change my whole life and future but I hate to say it, it has.
                                Im on probation for a fight I had two years ago I'm nearly at the end of it, I had to see my probation officer yesterday for the first time since the accusation, I told her and broke down in front of her.
