  • Trial looming

    Could anyone answer a question I have please......our barrister has requested a lot of paperwork that has not been disclosed to us, if it is failed to be produced what are the consequences? We have had some of the paperwork but not all of it. The trial date is looming up quickly now and starting to get concerned that this paperwork has not been sent to our barrister, he requested it at the beginning of December. Hoping someone can help

    Has there been a further case management hearing (FCMH) ?

    Evidence is often supplied late, often up to the first day of the trial. In that scenario the barrister will complain to the judge and ask for more time for late evidence to be considered, depending on how important that evidence is. disclosure is far too complicated for a layperson such as myself but I think the legal arguments would be carried out along the lines of balancing the defences disadvantage by not letting the Jury hear the prosecution evidence that the missing documents refute, rather than throwing the case out for abuse of process...

    (anybody know if I am on the right lines here?)

    Your legal team are the ones to ask but quite honestly, there is nothing you can do to get those documents any quicker so leave it up to them.

      No there has not been a FCMH, would every case automatically have one of these of just if requested?

        This is from the LA better case management document;

        A Further Case Management Hearing (FCMH) will only occur in identified complex cases or if a judge
        decides that the interests of justice require a further hearing. Following which, the next appearance
        in court should be for trial.


        I had a FCMH, basically because the judge needed to bang the barristers heads together. They are supposed to work 'rapidly' together before and after the PTPH to avoid the need of taking up court time sorting out their squabbles.
