  • Where do I start?

    Hi - I just joined a few days ago but I've been looking in on everybody for the past year and just watching. Picking up odd bit of info and realising its not just us going through what we are going through - which helps! So I wanted to say Thank you.
    I wonder if anyone can help us - I am so sorry but I really do not want to give too much info away because after the year we have had i don't believe in anything anymore - except my husband of course.
    Two main things -
    1/ my lovely lovely husband was charged with sexual offences - in a few days it wil be a year and the CPS has not decided anything - We live in Scotland - We have been told that there is no time limit and only that they can take a reasonable time - What does that mean???? Every DAY is a day too long!!!
    2/ It is a historical case - lets just say - Over 25plus years ago! and lets just say my husband thought his life was just begining!! so you can work out how old he was when these offenses took place - When do you become responsible and an adult in the eyes of the law - He was just a kid at the time of the accusations.
    I obviously wasn't there when these things were so supposed to have happened but I know my husband and all our friends do as well who have supported us 110%.

    It appears that the age of criminal responsibility for children in Scotland is now 8 years.

    However, if the law (on this point) in Scotland is the same as in England it might be that the "age of criminal responsibility" at the time of the alleged offences was different. Therefore, you need to clarify what the age of criminal responsibility was at the time of the alleged offences.

    Further, English Law (as far as I know) dictates that if a person is convicted for crimes or alleged crimes, historically, then he must be sentenced to the guidelines that were in place at that time.
