  • Bad sequence of events

    Hi all,

    Was reading some of the posts and debating to add my story. I am a little nervous about the situation I ended up in the other night, so, here it goes:

    Was on a work day of drinking celebrating promotions. Was only meant to be a day think ended up being a day and night thing. To cut a long story a lilttle shorter a girl joined our group and ended up following us around. We all left the last pub when it closed and this girl and I ended up together.

    As I had been drinking for most of the day and when the fresh air got to me things became very hazy. We ended up having sexual encounters in the street, very dignified, I hear you mutter. As we were in various states of undress somebody drove passed and called the police. When they turned up, which sobered me up no end, they said they wanted to make sure that it was consensual. Fine, I thought. They then said that she was very drunk, as was I, and they can't understand what she's saying. After about 5 mins she said she couldn't remember and that's when the cuffs were slapped on!

    Police station, cloths and phone taken and family members informed. Two weeks on now and to the best of my knowledge she is still sticking to 'I can't remember'. I know that this was consensual and that cctv

    Hang in there! It might be a long wait for a decision but it sounds as thought she's been reading too much about the Ched Evans case.

    Make sure you write down everything that YOU remember in case you need to insrtuct a solicitor later.

    I hope you get a decision sooner rather than later though.

      Hey,

      Thanks for the comment and yes it did strike a cord with the Evans case. I even mentioned it to the duty solicitor. Yes a long and nervous wait indeed, never been in trouble with the police before so it all abit harrowing.

        Just some advice please

        The police have started to interview all of the persons who were part of our evening, work colleagues and the like, which is great, and as I am a month away from my bail date I was wondering whether it's worth getting a paid solicitor now or wait for my bail date?

        I have the duty solicitor at the moment but he is not that great at getting back to me with emails and is not inspiring me with confidence.

        What a **** Christmas ahead!

          Duty sols are not paid to answer each and every email. If there is no update then there is nothing to update you with. If there is an update he or she will let you know.

          I appreciate that this is frustrating for you but it's par for course.

              Which area are you in? Just in case I know of a decent sol in the area.....

                        Thanks again. Just a quick question if I may. The police have a civilian ex member of the Met collating the statements from my work colleagues . My Bail date is the 5th Jan. If the police finish interviewing all parties next week am I more likely to hear before Christmas, or as I am thinking, the closer it gets to bail date and I haven't heard anything that means I'm getting charged and going to court? I assume all of this is dependent on how long the CPS takes to turn this around.

                        In my eyes this should be straight forward to investigate, however, I appreciate my is not the only case the police are dealing with.

                        Thanks for you advice I have saved Harvey Fox in favourites in case the worst happens

                          All it means is that the police are up to their ears with sex cases and nobody can say when they will come back with a decision.

                            Post 'Evans' I would imagine that the Police/CPS will be VERY cautious with how they proceed.

                            There could be charges relating to public decency with the 'witness(s)' being those who happened to get an eyeful driving past...

                            It's a strange situation to find yourself in. Both parties being highly intoxicated cannot mean that the male is automatically guilty of rape, or so 'Evans' leads me to believe. It's not for me to give a cast iron legal defence though and you will require the services of a credible legal advisor. Rights Fighter has provided you the name of such a person. DO NOT hesitate to use their services should a charge or charges materialise, look at what happened to Mr Evans when he didn't have the best legal advisors...

                            As for bail. I'd imagine you will be re-bailed in January. The Police & CPS will take their time to fully analyse the situation and decide on how to proceed. The longer things go on for then the more strain will be put upon your mind, do not be afraid to seek help sooner rather than later, none of us is immortal and highly stressful and unknown situations easily sneak into our lives and take over.

                              Thank you for your advice. I have decided to seek the help from the Sol that Rights Fighter provided. He has assisting with another Sol who also has expertise in my area of work (military). I have been in fact told that I shall be reinterviwed in Jan for further enquiries and disposal decision.
                              You are correct with all that you have said I do believe there would be a charge of some kind coming. I really hope it isn't the big R! I have been feeling totally stressed like everyone else on here.
                              Going to see Sol next week prior to interview so my have a better understanding on what's round the corner.
