  • falsely accused (Advice regarding appeal required)

    hi, im new and was looking for some advice. a family member was arrested accused and sentenced for a sexual crime he says he did not commit. he was sentanced to 16years. apparantly he has tried some solicitors for legal aid but it seems the case is to expensive for the legal aid budget. has anyone got any contacts for companys that deal with these cases that wont cost an arm and a leg

    There are too many charlatans out there who charge an arm and a leg and do very little, if anything.

    Go through the case yourself first and see if you can think of anything that went wrong with the "investigation" and at trial, attitude of judge etc.

    LA sols are not paid to investigate the case so you need to do that yourself before making contact, then give them your reasons as to why you believe this to be a miscarriage of justice.

          Legal aid has been cut to the bone, that includes LA for appealing convictions. The result of this is that many firms no longer take on appeals outside of their own cases (trials that result in wrongful convictions).

          Gone are the days when a client could send their paperwork to a LA sol who would then be paid by the hour to read it properly and then come to a view. They are now paid around £240 for 6 hours of reading. They cannot possibly get a proper handle on the case in that time and speak to potential witnesses.

          The work I do on appeals provides a comprehensive background to the case and my own views on what might be grounds or arguments for an appeal. It saves the solicitor hours of work. I do this for private clients too as it cuts down on their costs.

            so how much is he looking at for you to read through the case?

              I do not charge for my time and never have done.

              What I do is to provide a comprehensive background of the case and potential arguments and/or grounds. This then goes to the solicitor or direct access barrister as it gives them a broad background of the case so saves them several hours.

              I am already up to my ears with appeal work so am not taking on anything else until I have completed the three I have.

                  Not a good idea to leave your contact details on a publicly viewable forum. Anybody passing by could end up making contact with all sorts of nasty things being said.....
