Question regards BAIL

Hi

Without going into details exactly, as some of you may be aware unfortunately we have been sucked into a false life damaging allegation of rape.

Basically, if someone is placed on unconditional bail, and also if someone is placed on conditional bail but the only condition is to live at a certain address, does it show how the CPS are not happy with the allegation?

I believe it's at the discretion of the custody sergeant at the point bail is made.
I don't think it has much bearing on the strength of the case.
More in the character/status of the person bailed.
Such as previous convictions, likelihood to interfere in investigation or with witnesses, possibility of leaving the country etc etc.

Obviously if the person bailed is considered to be a threat there would be stricter conditions, but the police are supposed to consider them innocent until proven guilty so should just weigh up the above factors.

Wish I could say, yes - it's because it's a very weak case, but I can't!
Although there's nothing wrong with thinking the best!

Bail conditions are not a sign of what the police or CPS think of the allegations.

If a person is likely to interfere with witnesses there will be a condition - usually not to go within a certain area and within X miles of the accused and their material witnesses.

If there is a risk of the accused fleeing, they may well be remanded into custody or have a condition which means they are tagged, or bailed to an address so the police know where to find them and/or have a curfew.

It is nothing to do with how "dangerous" the police think a person is. It is about ensuring that either side do not speak to the other or go on the run.

I also think that it's a matter of what the particular officer 'normally' does. My man got bail conditions that we thought were totally unnecessary as he/we had no intention of doing what the bail condition forbad. On the other hand, we were amazed that there wasn't a condition that were were expecting. There seems to be no rhyme or reason.
