    Hi,

    When my partner was wrongly convicted of Rape in 2005, he discussed appeal with a solicitor who informed him by all means he could appeal but if he was successful he could face a longer sentance possibly life!!!!! Is this true as i think we should fight this, but he is concerned he is gonna end up in prison for life which would be unbearable please give some advice.

    Methinks your defence team does not want to appeal this conviction because they stuffed up big time at trial.

    On rare occasions when an applicant prepares their own appeal that is based on "frivolous grounds" and is a waste of the court time, they can be made to serve their time as an appellant again. This means that from the time they have been allocated an appeals number.

    However, if an appeal is prepared by a solicitor or somebody who knows what they are doing then this would not happen.

    You are now a member of PAFAA forum so why don't you post on there? I don't check this forum every day.

    By the way one appeal I've prepared myself (without a solicitor) has been considered by the Single Judge who has given funding for a solicitor and for an expert witness. It is also being fast tracked so it seems this one might work. I've sent it to the solicitor I work for.

    Yippee! Wandsworth Paul, his partner and me have been walking on the ceiling all day! Hurray!!! Good news for a change!!!

      I wish I could advise you, this happened to my son, I thought of everything, even sending him out of the country, its just such an awful threat, the jail sentence could be horrendous, he was only sixteen at the time. It all went ok for him, thank god. but ONLY because she said at the last min, "I cant remember!" (prob to save herself from prosecution, when he was found not guilty?) after putting my entire family through a YEAR of sheer hell, waiting for the court case.

      Remember there was only two there at the time, and and its only one persons word against another. God be with you.
