Father Charged

Hi,

My father has just been charged with historical sexual offences. He has already been to Magistrates Court in January. Thereafter he went to Crown Court February whereby he pleaded. A trail has been set in September 2016. Can someone please inform us of the procedure such as witness statements from the CPS and other disclosure else. We are already trying to contact the students he taught at that time and they are all prepared to come forward.

We would really appreciate of the procedures involved and timescales involved and what if the CPS does not meet the dates as set by the judges

What is his solicitor doing in all of this? He or she should be advising him......

Hi,

Its just that my Solicitor is away for the next 3 weeks, and its not a joy him being on Legal Aid. Thats why we just wanted a step by step procedure. I would really appreciate this.

You can talk to people who you believe may be able to help. Try looking on Facebook and other social networking sites - that is a good start. You mus be careful though who you speak with, as if they are "troubled" you could end up with false allegations being made on the back of the original.

Yes you are absolutely right in regards to Facebook.......In regards to the procedures say from Crown Court to CPS disclosure/s what is the time involved and when do they have to provide these in terms of days as stated My Father has already been to Crown Court in February. Can someone who has been through this procedure please please please explain. I would appreciate any feedback............

Please don't allow yourself to be swayed by time procedures. CPS rarely stick to them and often come under fire from the judge in pre-trial hearings.

You need to start your own evidence gathering now but be careful how you do it. Facebook screenshots can be used as evidence at trial, so try to find the accusers profiles and check how much you can see.

Comments on photographs can be useful as well conversations in the timeline. Look for references of "being in the money soon" if they claim to have "found an easy way to make money".

Thank you for your feedback RF so CPS can delay things so the trail may also be delayed. So basically if money has been mentioned in some sort of form this would help and obviously inconsistencies is another issue altogether. I know one of FA is on drugs and has mentioned money worries previously to one of Fathers Students and he has lost vast amount of money.

Thank you once again. I know money has already been mentioned and the fact they were struggling for even have a holiday due to money worries and he has lost a lot of money due to drugs/ gambling. There are 3 FA and the trail has been set for 4 days. There are inconsistencies anyway which will be dealt by Barrister.....However you are absolutely right its all about monies and threats have been to my Father that he must pay or face the consequences and we have correspondence from another FA......disclosed to Solicitor.

The Laws are terrible in this country giving compensation to FA

Yes my father does have the demands its all written in the letter that was sent out to him out and also have evidence that another man has said he is struggling with money and he has lost vast amount of money which in itself is a motive and then there is the inconsistencies, then finally they are both related.

Yes and finally its getting the right Barrister..........If we were going to go private do we let the CPS know or will they automatically know?

Anyone heard of Stuart Sutton my brother has just spoken to him at Tuckers and he said he can take the case on and will use Mark Kelly as a Barrister. The costs are quite reasonable as well........But need to move fast.................

if he's eligible for legal aid then I would go for Marky Newby http://www.qualitysolicitors.com/jor...ple/mark-newby every time, if you are in the NW or NE area. He uses Mark Barlow the barrister. Although he shows as being at Garden court north that has recently changed, I believe. Together as a team they are formidable and they both do legal aid.

I assume you are in the NW - ish as that is where Stuart Sutton is based. He didn't have a very good rep the last time I heard about him, although that might have changed.

If you are seriously considering going private I would suggest you ring Chris Saltrese 01704 535512 - his costs come with a QC or senior barrister. Members in these forums have used him.
