Hi, any idea if an old model type phone of my husbands that was pay as u go can be looked at to retrieve old deleted messages ? Is this possible or has anyone had this done etc ? Using legal aid?

I've not had it done but I know with most newer phones that if a message is deleted, there is usually still a record of it stored somewhere deep in your phones memory device. Your phone is a bit like a computer and some stuff is never erased unless you buy specific programmes which enable you to do this. I'm not sure about older phones but it's still worth enquiring to see if you can retrieve something important which helps your case?

Its all down to the size of the memory card , modern phones have huge memorys . When you send or recieve texts the phone stores them into the memory and even when deleted the message is still there. These are only lost when the phone runs out of fresh memory and needs to overwrite old deleted data. So on a new phone your very first message will probably be there but on an old one with a small memory it may be not as it will have been overwritten. The only way to know is to have it analysed.

So is it easy to get legal aid to fund for this if it will help my case etc?
Also , if we are able to do this do the results from forensics analyst go firstly to the solicitors first or back to the cps ?
