    Over 18 months ago, my brother made a false allegation against me to the Police that I sexually abused him when he was 14. The police investigation took 16 months and caused me considerable distress particularly in my job as I worked with children at the time. He has a history of making false allegations and previously told the Police my father had a firearm weapon and was going to kill my mother. this resulted in my parents home being searched and them both being interviewed by the Police. However, it was clearly false because he hadn't spoken to my parents for 18 months at the time. Furthermore, he also sent four letters to my parents from a bogus solicitor accusing my parents of child abuse and saying they had been reported to the police and needed to hand themselves in. In the last two letters, the bogus solicitor requested a financial settlement. I handed in these letters to the Police and we were then told he had also made allegations against my father which were also being investigated as a joint investigation which eventually all got dropped.

    As I work in a professional capacity, there was also an internal investigation by a LADO which concluded the allegation was malicious. I am aware from conversations with my employers that the Police told them there was absolutely no truth in the allegation and there was evidence of malicious intent to make an allegation which has led to him being investigated.

    Regardless of all this, I received a letter from the Police stating the case had been dropped due to insufficient evidence. I went mad. The letter infuriated me because the allegation was completely false and their letter indicates there was some kind of evidence to support it.

    I went to see my MP and showed her the letter I received from my employers and the Police and she said its impossible for the allegation to be classed as malicious but also lack of evidence. She agreed to contact the Police about the matter. In the meantime, I have also made a formal complaint against the Police about the matter and several other issues and been told I am entitled to a victim rights review assessment.

    The Chief Detective Inspector phoned me and said because there is no evidence to say the allegation didn't happen they cannot record it as malicious. I asked him what would be on my DBS and he said there should be a record of the allegation together with a note saying there was no evidence to support the allegation and I produced evidence to undermine it but there is also no evidence to say it didn't happen. He then said it begs to question whether we should even include it if we are saying that.

    The whole thing sounds very contradictory and I am angry it will still be included on my DBS. The Police have admitted the evidence I produced undermined the allegation so in my view that is evidence to say it didn't happen and my accuser has no credibility. My accuser is also under investigation for fraud and will be asked about perverting the course of justice.

    What does anyone think about my case? I don't think it's very fair the allegation is put on my DBS which could lead to employment discrimination and it should be recorded as malicious too. I'm thinking of escalating my complaint against the Police.

    I think this is a massive issue that the police cannot seem to grasp, it's an injustice to have a record kept against you when there is no evidence.
