Jury Nullification - Criminal Law
"Jury nullification occurs when a jury returns a verdict of "Not Guilty" despite its belief that the defendant is guilty of the violation charged. The jury in effect nullifies a law that it believes is either immoral or wrongly applied to the defendant whose fate they are charged with deciding."


It's an absolute shame that jurors are not made aware of this law, prior to trials. I'm sure we'd have a lot more innocent people out on the streets at the moment.

They are directed as to the burden and standard of proof by the judge, which should cover that. Let's not forget that the jury gets it wrong in two ways:

The innocent are wrongly convicted

The guilty are wrongly cleared.

Jury Nullification seems to hint at 'freeman' thinking.

The judge can direct a jury to find a defendant not guilty. I have recently read a few appeals (Scotland) where the judge has done so/failed to do so.

Juries cannot nullify legislation, it would be good if they could as there are plenty of garbage pieces of law.

A jury can decide all the facts before it and find an accused not guilty regardless of what a piece of legislation says, they are their to provide their opinions on what the facts say TO THEM. The judge will step in where there are issues, in law, which means that the accused must be found NG.

There are cases in the USA where jurors have spoken out after verdicts. I think in Michael Jackson's case they said they believed him to be guilty but they have to come to their findings on the evidence
not on their beliefs.

A case I was involved with in Idaho, the jury foreman said afterwards that he believed him to be innocent. Our man was sentenced to 20 years but was released on appeal after serving 7 years.

The defendant in that case, his wife died in front of him during a prison visit. She had been a friend of mine and a member of PAFAA. As she had problems joining the group I did it for her, so I knew her passwords. After she died I managed to get into all her accounts and change the passwords - just as well because a couple of days later the lying side of the family attempted to get in.........
