Hi to all members.My partner been falsely accused by his ex-partner and her daughter of sexual abuse and he been convicted already.We received the refuse on our first application for leave to appeal,by the single judge and now we re looking for a new legal adviser to help us go further for the second chance to appeal.Whoever i contacted,they all say is for private,but also not everybody want to accept at least to assist in this matter,so i keep searching.Help me please,if you know anything about that or if you or your family,friends were in the same situation.

As I said on FB, he won't get legal aid to "renew the grounds" which is why solicitors are saying you have to pay.
As the SJ refused then he can get legal aid for an application to the CCRC - I sent you a link on Facebook. However before LA is allocated, you have to have some sort of argument. If you pay privately there is nothing to suggest that grounds will be found of course. Money does not equal grounds of appeal.

right,they all work for private in this case.
for the second chance,there is a hearing in front of 2/3 judges, but we need new grounds of appeal or new evidence...i don't know what we can find new for that or can apply to CCRC,which also need for a new evidence,in case they accept to take the case...

also,how can i find the right solicitor,because they all on private,but not all are really taking the case serious and work on it,they may charge a lot,but we never know who is the one to do the job for real,not just talking and promising empty things...

To renew the Grounds there is no legal aid.
To make an application to the CCRC there is legal aid but only enough for two hours work (at first). That is not enough for a solicitor to go through it all and then find Grounds. It helps if the inmate or a supporter can think of something that went wrong at trial (besides the verdicts of course!) but unfortunately there is a language problem here.

yes,i ve read about the Mr.Legg.i also contacted him already...will wait for an aswer
i also had contacted others, one of them advised me to apply to CCRC and to not lose time applying second time to Court of Appeal,also it can cost cheaper,because everyone has own quotes and most of them are pretty high
but as far as i know,CCRC need a fresh evidence,which i have no idea how to find it,and also may be there r more evidence,but weren't disclosed at the right time...

CCRC don't need fresh evidence. They can refer a case based on misdirections by the judge. it really annoys me when people are wrongly advised like this.
The reason the barrister didn't go further from what I saw, is that the SJ may have initialled the box at the side of his signature, and that if it went further and failed, the CA can add time to serve, from when the application to appeal was served to the day it failed.

actually that s what i was thinking by the way our solicitor told me,but the box wasn't used,not ticked or SJ name there,so,they say is a risk,but they didn't use that box on the right by the hand writing.
so,our solicitor also misdirected us..if honestly
but yeah,will think abt CCRC,asking for fresh evidence,they write that on their website also some solicitor told us,but only one actually advised me today to send application to them
barrister won't tell me the real reason why they didn't go further with this matter anyway
and now again we re in the same place,where we don't know what is best and will we find justice

The real reason is in the handwritten response from the SJ.
