  • Accused of rape

    My son last year got arrested for rape and abuse of his step sister in year 2008-2009 - we went to the police station on numerous occasions to be told in feb this year it was likely the case would not go any further and his bail was cancelled- in Dec just gone the girl took her own life as her boyfriend was cheating on her she had issues upstairs as very time she got rejected she tried to end her life - she had issues also upstairs about her mum and dad splitting up, my son and his step sister had a huge argument and this seems to be the start of the problems - she did not tell anyone for years she just came out with it and took his step mum and dad by surprise . she also tried to get someone else done for rape but she dropped them because she was getting death treats, I have seen various clippings of this girl and she does not look like she has been abused
    From feb until last week we heard nothing at all our solicitor e mailed on various occasions and had no response so the email our solicitor rec was a total surprise and shock to be told my son was been charged - the police came to our home and told him that he will be receiving a court summons
    I do not know how my son is going to defend him self as there is no one to ask or cross examine
    There is no evidence
    We have come to a conclusion that the stepmum has asked for the case to be reviewed , does anyone know of any legal aid solicitors

    Hello and welcome to the forum,

    Sorry to read your story, it's tragic in so many ways.

    I've not heard of this situation before where the accuser will not be able to appear, though presumably the case will be presented on the basis of her video interview.

    It certainly seems wrong that your son's barrister will not be able to cross-examine this evidence, though that in itself will be a powerful defence tool; very important in this instance to get a specialist.

      Thankyou I know what you are saying we feel so one sided sometimes I think that some one is playing a joke and I say now is enough please stop , Falsely Accused have recommended a solicitor it's the waiting that is killing us , waiting for the court summons to come , we do think that the step mum has something to do with it she is a nasty lady and I am very
      very sorry to say she plays on the colour Thankyou again xx

          Unfortunately I will be away from the PC for most of the day but if this is the Falsely Accused site that I think please take note of other member's experiences with them (perhaps by doing a search on here if no-one responds)

            Rights Frighter? I know I can be scary sometimes!

            You mention FA'd website. Have you signed anything with them yet? If not, I would seriously advise you not to do that. You mention legal aid solicitors so I'm thinking that that you would not be able to afford him or his sols in any event. You would need to check out various threads relating to him. There is little or nothing positive there.

            Which area would any potential trial take place?

              Falsely Accused have recommended a solicitor
              As has been mentioned, if you're talking about www.falselyaccused.co.uk, my advice would be stay away, well away. I'm £3.5k lighter as a result of making that mistake. If you're panicking and not thinking straight, it's easy to hand over the money, but in this instance it would be a mistake. Their are many good legal practices that will advise you on your status and advise you not to fork out unnecessarily. Whatever situation you are in, I'm afraid you're playing a long game. Sit tight, try not to panic and think things thru' very carefully before you make any decisions, certainly about handing over large amounts of lolly.
