When the police take a statement from a witness or alleged victim, they always ask if they are "willing to support prosecution"
This means are they willing to stand up in court.
They are asked this as standard when making a statement and it is written into the statement when they sign it.
This is still at the evidential stage and before the CPS get to see the file.
It certainly doesn't mean it's definitely going to court.
As always tho, hope for the best, prepare for the worst!
Try not to panic, it's a process and it's a long one.
Try and focus on the parts of your life you can control.
There is nothing you can do while the process continues.
Keep positive and be strong!
You will get through this!

I have just had a call and after a year on bail the cps are charging me and it will go to court.
Im so scared and worried. How can this be right?
My bail is end of march and im set to appear at crown court at end of april.
I have no idea what to do. Im not even sure if my solicitor does as well.
Cam this still be thrown out? What of the acuser doesnt attend court or a key witness wont testify?
I dont know whay to do.
Please help.

Ok, try not to panic!
You're going to be all over the place right now.
Being charged does not by any means mean you're guilty.
You know you are not.
Emotionally you will be up and down like you never knew so look after yourself.
Practically though you must find a specialist solicitor once you are charged.
You don't need a private solicitor and a legal aid one is absolutely fine as long as they specialise in these cases.
There is a thread on here about specialist solicitors, private and legal aid.
It depends where you are in the uk who you choose but don't put that on here as it's an open forum.
You may want to keep where you live to yourself.
So have a look through and find a good one.
Having the right representation is half the battle.
Try and keep positive and look after yourself, this will be the fight of your life and you'll need all your strength to get through it.
Remember to ask for help on here, emotional or practical and we will do our best!
Being scared and worried is normal, it's an alien situation.
But trust your innocence, you didn't do it.

This must have come as a blow, but this is now your opportunity to fight back at these allegations.
Up until now, you have been playing the waiting game, sitting in silence to await your fate. Now you have the chance to pick holes in the case against you. Cases can go to charge on the basis of just one word, remember.
As the poster above has advised, your first port of call should be finding a solicitor who specialises in these cases. As said, do not put your location here BUT you can specify your county if you like and someone may be able to recommend someone
Once you have found your solicitor, tell them absolutely everything and pass on anything you have built up while on bail (this may be nothing - sometimes there is actually nothing available) and what the solicitor should then do is request all evidence from the police - including the unused bundle which is evidence they decided not to use as part of the case. This could contain stuff that will help you to defend yourself but occasionally, police forces are not forthcoming with it so the solicitor should always push for it and ensure they have everything.
Then, get your own head straight, remember that you are innocent and prepare to systematically pull apart the lies against you.

Does anyone know of any good legal aid solicitor's in south Yorkshire?
I'm not sure what to do about work should I quit my job? They don't know anything that is going on.
As the accuser is lying, what if she doesn't appear on court? Someone I know had the same thing happen to him. He was charged but it was thrown out before court.
I feel so lost at the moment.

difficult to answer but what would their reaction be if they were to find out you were appearing in court: If it's along the lines of "oh well..." then just book time off to cover the court case and go back when you get the ng verdict!

Sorry to hear this news, how are you feeling today?
Your FA sounds awful stealing from you and falsely accusing you! Try and keep calm and keep things clear in your head your telling the truth so you don't need to have an excellent memory. She does to remember all her lies!

Feel terrible today. Just want to stay in bed.
I don't know if my solicitor is any good or has any experience in this field. I spoke to Gerry but he now only does private work.
I'm only on 16k a year. Will I even qualify for legal aid ?
My partner of now a year has been so supportive. I'm struggling to see my kids as when I do my head is a mess and I start thinking what if I never see them again.
So not great.

I feel like just staying bed almost every day I have to force myself to work but I do it because life does go on. A friend of mine said to me the other day you don’t know hurt until your 2-year-old son dies and the first thing the police do is arrest you for their murder and lock you in a cell. His son died of natural courses, so as hard as it is you do have a lot more than others force yourself out of bed focus on life on winning. Life is a gift one chance is all you get you will come out the better end one day. Nothing is forever.

Its been a while. The last few months have been a living hell. I don't want to be here anymore every day is a struggle I'm so worried if things go wrong.
I'm due in court for my trial early March. I have a conference next week with my solicitor to review all evidence against me.
I have so many questions running through my head. I appreciate that some will not be able to be answered.
Here goes.
Can this still be thrown out at court ? If the accuser fails to attend court ? Is this highly unlikely now at this stage.
My trial is set for 3 days there is only two witnesses the accuser and her mother. What can in expect in court ? I understand that the accuser will be asked to give evidence via video link. How can this be fair ? I assume I will have to stand in the docks in court. It makes me feel sick.
Can the court date be moved ? Will the trial be over in 3 days or could it be adjurned ?
I don't know what to tell my partner and family about when the trial is, as due to the nature of the case its very personal in terms of the consented sexual acts that had taken place. Part of me just wants to deal with this on my own.
Will my solicitor be able to give me an idea of where I stand once we have reviewed the evidence ? The not knowing is killing me. This has been nearly two years now my life has been destroyed.

Yes it can still be trown out by the judge or the prosecution can offer no evidence. I think its unlikely but can happen.
My accuser is doing video link I think it will be just as good as being there they can still observe her you will be in the docks apart from when giving evidence then you will be on the stand.
very unlikely it will be moved but can last less they say 3 days could be two.
Do not deal alone I have started telling more people now and the support is great if they know you well enough they will know you are innocent trust me get support.
The not knowing is killing me. This has been nearly two years now my life has been destroyed.
He will tell you what his thoughts are on the case if he really thought you should plead guilty he would tell you too.
