Marynaz - fab to see you back!
    Good afternoon Rights Fighter.

I will submit the requested logs. In the meantime I have sat down wrote my timeline with specific dates and possible motives. I have discovered numerous points that discredit her accusation, but there is one point that is so strong that I can't believe I did not think of it in my interview and I have virtually no idea how she would present a credible answer to it if proposed to her.

Should I keep this as a trump card? I am pre-charge still, so I am unsure of how much I should be revealing of my defences to the police.

The best person to ask is your solicitor, however, if this was me, I wouldn't reveal anything else unless the police called me in for a reinterview.

        Just an update.

I have now had all my electronics returned without inspection, minus my mobile phone which has been retained for inspection.

I went back to work yesterday too which was hard. I am experiencing a lot of anxiousness when out in public and finding it difficult to concentrate on anything. The hardest part was returning to our marital home and now living here alone after what has happened.

The torture is nearly unbearable. The duty solicitor present at interview has requested me bring him a copy of my timeline for him to read through.

I am holding out on contacting any specialists right now because understandably they do not receive legal aid for pre-charge cases, but I am looking at Gerry McDonald as a potential if he still accepts LA. Do you think he would mind an e-mail giving him a heads up or would you guys recommend holding out for that?

Gerry told me a few weeks back that he won't be doing any more trials as he's had some sort of promotion. He's doing the trials he has already committed himself to.

I would suggest in the event of a charge you contact Paul Legg at Freeman's solicitors

          http://www.freemanssolicitors.net/si...file/paul_legg

Solicitors can't help at this stage and emailing them only adds to their workload.

          Hold on in there.

Thank you Rights Fighter, I'll keep Paul in mind.

In the meantime, 3 and a half weeks after being bailed the initial shock of the event has subsided now. I've been working away for a while which was a God-send for taking my mind of everything. I went through a mourning stage of losing a wife, but recent events have developed to indicate this was not entirely spontaneous and has been planned for at least some time.

I won't go into the details, but either way she has not left the UK and is trying to find work in another part of the country, despite having no connections here apart from myself and my family.

Who in their right mind would stay here under those circumstances?

Still can't get hold of the OIC to find out where my other set of house keys are too. Literally anyone could walk in at any time.

Called OIC to check on case progress as I am now over half way through bail period.

Was informed my case is with the DC's Inspector who is going to come back by Friday to decide the progress of this case.

Don't want to get too excited or hopeful, but if it is with the Inspector to decide on its progress when I still have 5 weeks until I answer my first bail, could be that my FA has retracted or doesn't want to pursue it?

Who knows, I will find out Friday!

Called today, the Inspector still hasn't got back to my OIC but should do by the end of today so I am going to call back tomorrow.

Wasn't really given an indication on what is happening, OIC said it would be unfair to indicate anything over the phone until their Inspector gets back. But to me it sounds like the Inspector is deciding whether to continue with this case or drop it.

I have some ideas of what might have happened:

                  (1) My accuser could have bottled it and fled the UK and given up on attempting to switch visas, which means they now have no witnesses to attempt to prosecute so needs signing off to be NFA'd
                  (2) They checked my phone and found no supporting evidence, and are deliberating whether to NFA it - not sure if they can check a phone in such a short amount of time though
                  (3) They are deciding whether the CPS should take a look at it - again it has been a very short amount of time to gather evidence

Either way tomorrow should be interesting. I haven't really seen many cases on this forum where something like this happens.

It's easy to theorise why something has or has not happened. If the OIC cannot give you any definitive answer, that's because there isn't one. If they have to wait for the Inspector to get back, then that's what they have to do.

The Inspector will be looking at dozens of cases at any one time of course. He may or may not have already made a decision but that decision can only be given by the inspector. He also may have to wait for further evidence, or to finalise a decision, maybe he has to cross the t's and dot the i's - as they say.

They have procedures to follow and they will get to your case when it comes up in the queue.

All you can do is to sit it out and wait.

Plus of course the OP has only been bailed for a few weeks so far. Some wait two years - so it's pointless trying to find out any updates. You will be told as and when they are ready.

Since being arrested I only called the OIC once for an update on whether my phone had been examined, and that was on Monday. The OIC did not actually answer the question about when I could have my phone back, but straight away said the case is with the Inspector and I should call back Friday so she can update me on what is going to happen.

Today she told me to call back tomorrow for a full update since the Inspector had not got back at the time when I called today.

This is why I find it odd - it is the police themselves actually asking me to get in touch so they can update me, as opposed to being totally silent until my bail date.

I think the OIC on my case may be more helpful than some other case OICs though.

I would still treat it as "wait and see".

I concour. This is the attitude I'm having towards my case, as much as I'd like regular updates I'm just waiting. Last thing I'd want to do is come across as a mitherer, police are busy enough without having to be delayed by our phone calls. They will inform us when get are good and ready, stay strong.

Indeed, the police are busy enough as it is, especially with the cuts to their budgets.

The events in the last few weeks has humbled me a lot. First the Russian flight crashing, then Remembrance Day, then the events in Paris last night. This situation kind of pales in comparison to all of those, so in a strange way when I look at the people suffering due to those situations and look at my own, mine seems like nothing.

Oh well, grind on we shall.
