  • Need help for parole hearing

    Hi
    My brother in law was sentenced in July 2013 for raping his wife. He still maintains his innocence as the wife only did this to get a UK visa. See previous post on this. He is due a parole hearing in January 2016. I just need some advice on what criteria they use for assessing parole applications and what the chances are for sex offenders. He keeps telling me that the chances of a successful outcome for sex offenders are next to nothing.
    Are there any good parole hearing lawyers in Scotland who can help him in his application?

    Which part of Scotland? Glasgow, Edinburgh or further north? I know of one in Glasgow

      Hi Rights Fighter
      Preferably Glasgow.However if he requires to make frequent visits to the prison, he is in Glenochil which is about 25 mile from Glasgow and 25 miles from Edinburgh

              Parole refused

              Unfortunately my brother in laws parole had been refused for release in January. He will now need to complete his minimum sentence and will be released in November 2016.

              I would like to know if there are any other avenues he can pursue to clear his name. He has lost two appeals and failed to have his case reviewed by the Criminal Cases Review Commission. He maintains his innocence and we know that he is innocent. There has been a grave miscarriage of justice but we don't want to sit on our hands and accept the wrong decision of the courts.

              Can he go to the Supreme Court or European Court of Human Rights?

                He is out of time for SC and ECHR although the latter may entertain it if there is a point of public interest / law.

                As it's been such a long time since conviction he can only hope that fresh evidence crops up in the future, possibly via social media, if the accusers still talk about it - or unless he was convicted on "inconclusive" medical evidence.

                  Thankyou Rights Fighter. Yes I had a feeling that it might be too late. However possibly looking at the medical evidence might be something to pursue. The medical professional that was used by our lawyers came to to a different conclusion than the Crown's medical team. But I don't know if the jury had looked at the crown's medical case more favourably and looked at all the other evidence such as the accuser crying in court, body language, independent witness testimonies etc.

                    Evidence the jury saw (body language etc) is now out of the window.

                    If you can afford to buy the JSU (no idea how much it will be as I don't know how long he went on for) then it might be worth your while getting that, to see if the judge summed up the medical evidence correctly.
