  • Falsely accused need help!

    Hi all I have been browsing the forum for a few months now but have only just joined. I was arrested 7 months ago and falsely accused of oral rape of a 16 year old girl. She was someone that I met whilst walking g my dog. She made advances which I dismissed there was never any contact. The girl suffers from mental health problems. The apparent rape was alleged to have taken place 18 months ago in the middle of the day in a busy city park whilst I was walking my dog, who I should add wasn't even born at the time of the alligation!

    I was bailed for 2 months, then again for 3 months, I was just about to leave the house today for bail when I got a email from the officer in charge saying they are still waiting for advice from the cps and they would let me know a date ASAP.

    This is holding me and my wife in limbo we are both scared and don't know what this means. My life feels ruined, I have no criminal record I'm a good standing citizen. I'm scarred in this current climate I'm going to be charged, once charged would I be remanded?

    I went to call my solicitor today to find out he has left the company .

    Another solicitor should take it over if one is required for re-interview for instance.

      Thanks ks for the advice, I will be looking for a specialist solicitor, what dose advice from the cps mean? I'm unsure what stage this is at, the police don't tell me anything!

        Which area are you in roughly and in which area did the alleged offences supposedly occur?

        A CPS lawyer has to look at the "evidence" and then decide whether there is at least 51% chance of getting a conviction. This is not about guilt or innocence, but meeting Government-set rape conviction targets.

        If you look at other threads you will see that many of our members have been NFAd (No Further Action) due to "insufficient evidence". Often it's because the evidence shows that the alleged assault probably did not happen, but they won't tell you that.

          Thanks that clears it up for me I am in Norfolk, and allegation was in Norfolk, I'm hoping to use my limited experience to help others once this nightmare is over.

            If you are charged I'll see if I can find a good solicitor in that area. Hopefully it will be an NFA though. Stay strong and positive!
