  • Our nightmare is over .. No Case to answer

    Well it's been 8 rebails and 15 months of the hell you all know. But finally my son got the never-thought-it-would-come, THE call, from our Solicitor to say that my son has no Case to answer to. It's Over. It's finally Over. I can't stop smiling. Like losing a concrete jacket.

    His False Accuser, who is clearly one disturbed individual, statement and accusation has been kicked into touch. It was proven to be wholly insubstantial.

    If you are in doubt as to whether to get Solicitors help in this matter precharge. Please take my advice and don't hesitate. Get someone who believes in you and who is a total professional. We tried contacting 4 solicitors after the duty solicitor. One we completely didn't trust at a very vulnerable time. Then one who's company was wholly inefficient. One was so ridiculously casual one couldn't take him seriously, but one, Hilary Doherty of ITN Solicitors London was absolutely superb. Faultless in all her dealings with us. So Professional with my son and with me too, but with a such a human touch and so calm under pressure. She was everything one could hope for and more. My son and our family was very comforted having her fighting our corner. Highly recommended.

    To all of you going through this. I feel for you. It's not a T Shirt I would want my worse enemy to wear. Get professional legal help you can trust and is the voice of reason when needed. Confide in your trusted family and contain it as best you can. To family, I would say Keep the Faith in your loved one. Don't falter. Your all being tested. Pass it.

    Love and best wishes is sent to every innocent person on this forum and to your nearest and dearest going through it with you. This may sound emotional but that's because the journey has been as you know. Good luck everyone X

    What wonderful news and I'm so happy for you and your son......

    In view of your comments regarding solicitors it was interesting to re-read your earlier thoughts about instructing solicitors pre-charge and of course it would be good if you could add your recommendation in the solicitor thread (and if they accept cases on legal aid or not)

      Fantastic news, it took a few days to sink in when our son got his nfa but the relief was immense. Now, in our world the sun is shining every day in a cloudless sky. Here's hoping that we read more rightful results.

        Thanks Casehardened. I have no idea what I have put previously and have no intentions of rereading or reliving this nightmare. The emotional nightmare this was, is life changing. I can only speak about what I know now in the cold or rather now, the warmer light of day. And I haven't been active on this forum very much lately at all just reading and taking notes from afar.

        Hilary Doherty has proved to be our staunchest ally and looking back without that excellent legal representation we would have been floundering about without any knowledge of the Law itself. With each rebail she was either present or constant in her contact of the OIC in the most professional and collected manner. Putting forward to the CPS how the probabilty of the Crown would not get a conviction listing each and every key factors bringing doubt on each part. But she had the hard facts, it's just putting them in the most logical and legal manner forward to the CPS. I'm not sure of the correct wording without reading it all again which I have no intention of doing again. It made for comforting and logical reading at a time when your loved ones life feels like it's in the hands of those that do not know him.

        Sure I will put her details on the thread. She doesn't do Legal Aid but we had two choices how to pay her. One was an hourly rate or one was a one off payment, which was comparatively reasonable compared to another we had been quoted. We chose the one off payment but then after for 15 long months and numerous rebails, it really was great value. Constant contact when needed or the odd reassuring email or phone call was all paid for. And her visits to the Police station where my son was re bailed her time was also covered we just had to pay her train fares. So I think it was great value for when your future is on the line. And so comforting to have someone so calm, so collected and so professional on your team.

        Now comes the rebuilding of our lives. But that's a nice place to be, but I expect it to take time. xx much love to all the innocent people out there and their families

                For those who cannot afford to pay, there have been many NFAs when the accused has had a legal aid solicitor who hasn't done much.

                However, Hilary sounds fab! I was dubious given her past association with a certain person but the way she has been with your son AND you is fabulous!

                  I am very new to this site, and logging on this morning, this is the very first thread I have read. This is also my first post. It is such good news, and very heartening to read. Its really brought me hope.

                  My OH was arrested in February this year, and I will NEVER forget that day. He has now been re-bailed twice, yesterday was the second time, and with no notice. He has turned up, only to be told - sorry you are not on our list, your date has been changed. Its now 22nd October, and I hope and pray every day to get a letter or call to say NFA.

                  Thank you so much for your post, it really has given me hope.

                    Im pleased to have helped you in some small way. Does he have legal representation? What my son had was Hilary Doherty phoning the OIC days before the rebail to find out what the next stage will be and the one thing he does never want to do is to go to a Police Station on his Bail Date without a legal representative. Ever. Once my son presented himself there and was with Hilary who guided him through several,hours of questioning with Hilary stopping the interviews to talk to my son on each point. Which is why it took several hours.

                    He needs that and someone you have confidence in. Shop around until you find someone who has faith in you and you have faith in too.

                    Don't be swayed by anyone on this board. Including me, every case is individual and the ones recommended on here so often we had very poor service and responses from. You need to find someone you have faith in and who has gpfaith in you. Use the names on here and call yourself.

                    I can only tell you by my own experience that this lady is meticulous in detail and has the most personable manner and approachable attitude.                       And of course with everything she prepared for my sons case also. If solicitors are doing very little that would worry me. Obviously in between the bail dates there is little one can do but if something is remembered or thought of that would help him. You need to be able to approach your solicitor and say, 'Het I just thought of this' ' Would this be very relevant?' And when she's preparing for the CPS that vital piece of evidence could be very relevant. I would, we all would do anything in our power to have employed her should he have been charged, as with the experiences with the other three we telephoned or saw I wouldn't have trusted them to defend me against a parking ticket. Hilary was in a different league. But her,prices were not. Your in a baptism of fire here. I will never forget that feeling of stressful quick learning. Never could that leave me. Xx
