Please respond. So depressed. Any advice.

Hi im looking for any advice. A girl accused me of sexually assaulting her on the 19th June.

The police called me and asked me to go in for a voluntary interview a few weeks later which i said thats completely fine knowing im not guilty.

I woke up in the morning to go there and the police called me again to ask if i could cancel that and come in the week later. Obviously i was quite annoyed because i wanted to clear my name but i agreed to do it next week.

The girl accused me of pushing her to the floor and raping her in a public place which is a massive lie .... I had gone to a night club with a friend and met this girl outside who was flirting with me and we ended up going behind a public toilet together where we were kissing and she masturbated me. ( I dont want to go into full details but everything was consensual and she was the first to make a sexual move)

We had intercourse for a matter of minutes as embarrassing as it sounds it was hard to keep an erection due to alcohol consumption.. The girl was quite annoyed and she even said to me ' do i not make you horny' .... After this we sat on a bench in the town centre and she said she was scared about hwr boyfriend finding out after cheating on him and i said the same thing as i was annoyed with myself for neing unfaithful to my girlfriend...

I told the police to check there CCTV and it will prove i did nothing wrong but she said to me unfortunately it doesnt cover all areas.. I know they have CCTV of us two together after this 'alleged assault' talking for 10 minutes or so then goingnour seperate ways...

Its been a month since my voluntary interview and I have heard nothing. My life feels like it has been placed on hold and i dont know what to think anymore... ANY HELP OR ADVICE WOULD BE GREATLY APPRECIATED. SORRY FOR THE LONG POST.

I can't work out whether you have actually been interviewed yet. If you were, did you have a solicitor with you?

Hi thanks for splitting the text for me. Yes i had a duty solicitor with me. She told me to tell them everything i told her which i did as have nothing to hide. Ive heard nothing back from the police. They have CCTV cameras everywhere in this poloce and i thought it would have proved my innocence by now? :/

And like i said we were sitting on a bench talking with each other for about 10 minutes before going our seperate ways. Would this be the normal behaviour for someone who has just allegedly been raped. Sorry for my poor spelling

Hardly, but then she may well have told the police that you forced her to sit in front of the camera.......

Twisted and skewed. Do not expect the police to investigate both sides. They are under pressure to meet Government-set rape conviction targets.

You are quite correct in your logic and undoubtedly this will be taken into consideration; nevertheless the investigation will have to run its course which may take some time.

Thank you for the replies guys. The article was very helpful. The waiting and not knowing is the worst part. I really hope that i get an NFA as i cant deal with the ordeal of going to court over a false allegation Do you guys know roughly how long it can take? Its been 2 months since she accused me. Can i take any positives that its taking so long or am i living on false hope?

Also i forgot to mention im not on bail or anything like that... The first voluntary interview i was supposed to attend was cancelled because the officer called me and said and i quote ' We are too busy with more important jobs so can we arrange for next monday'.... I then proceeded to say i wanted this sorted and asked her to check the cctv and she said ' We have but unfortunately it doesnt cover all areas, dont worry too much as we dont have enough evidence to arrest you '....... So confusing

Of course it's great that you have not been arrested or bailed but it means that the wait to hear anything may be even longer as there is no pressure on the police/CPS without the regular milestones of the bail dates to remind them.

A member who is in a similar situation posted recently that he was two years down the line and wondered what, if anything, was going to happen (can't remember his username unfortunately or I would link to his post)

Thank you for your response.. 2 years really? Thats crazy.. But surely if they dont have enough evidence to arrestbor bail then it cannot go to court? Or am i wrong

And i cant believe the girl would want to lie for that long... Her Facebook pics auggest shes having the time of her life partying, going on holiday etc... I think its worse for men who have been falsely accused because my life is on hold

Screenshot and save those photos. if she "creates a false impression" that she's been a hermit, never goes anywhere, can't be physically close to a man etc etc, then you can use that to "correct a false impression".

It's unlikely you could use the photos as evidence per se, but it's when a complainant creates a false impression, is when you can.

I've known people who were never arrested wait anything up to and past two years. Hopefully that won't happen to you, and you will know one way or another, soon.

Thanks for the fast responses. I will definatly do that. Are you a solicitor as i see your number at the bottom of your posts?

Also do a lot of these cases where people are not arrested go to court as i dont think i can deal with that? And does the girl have to agree to go to court to testify?
