    Hi all. Not sure where to start with this so I guess the beginning is the best place.

    About 3 months a go I received a message from my neighbour to tell me that police had been to my house looking for me. Not knowing what was going on I tried calling my wife but received no answer. Panicking I jumped in the car and started driving home to find out what was going on. As I drove home I was pulled over by 2 police cars and arrested for the sexual assault of a child under 13 years old. It was my step-daughter. The claim at this point was that I had asked her to masturbate me but she had refused.

    I was taken to the police station and had my clothing taken, fingerprints taken and intimate swabs were also taken. They also informed me that they had seized my laptop from the house. I was then locked in a cell. Hours later I was taken from the cell and further arrested for rape and digital penetration. I was then put back in the cell until my detention was extended at 24 hours. A few hours after this I was interviewed.

    The allegation at this time was that on the day preceding my arrest I had assaulted my daughter in my bedroom after she returned from school. It is utter rubbish.

    She did not return from school until just gone 3.25pm and asked if she could go out to play. I told her she had to take her mobile with her. I then realised she had walked back without her younger brother so I immediately sent her back to the school to get him. The school is about 150 yards from the house and she went back and returned a few minutes later with him, so approximately 3.30pm. I then made them both stand in the living room with me whilst I gave them a rollicking for not walking home together and they made their excuses. I then told them both to get out of my sight and they both went upstairs. We must be looking at at least 3.33pm now. I stayed in the living room using my computer for at least part of the time. As I don't have the laptop it is hard to say what I did for each minute of the time I was home but I have since been able to find some evidence using Facebook and Twitter for some of it

    Before 3.45pm my wife had returned to the house. We had a coffee etc and she went upstairs for a lie down. Again I stayed downstairs on the computer and at 4.29pm I received a call from a relative on the house phone. During the call my step-daughter came downstairs to ask who was on the phone. I told her and she went back upstairs smiling.

    When the call ended my wife came down and we had a discussion regarding some upsetting news the relative had told me during the call ( she was to start hospital treatment for an illness). After we had discussed this my wife said she was going back to bed and laughed that all 3 of our kids were in our bed watching TV with her.

    About 5.50pm I left the house to go to a local event. Whilst at the event my wife called me sometime between 7.15 - 7.45 asking me to have a word with my step=daughter as she was playing up. She came onto the phone crying and said "Mummy kicked me". My wife came back on the phone and said she hadn't kicked her but had nudged her with her foot after she refused to go and tidy her room. I assume she was sitting on the floor. At about 8.50pm I received a text from my wife to ask if I was still going to a friends house before coming home. I replied that I was. Myself and my friend were doing a car boot the next day and we had agreed to fill my car the night before to save doing it in the morning. I finally arrived home at around 10pm.

    When I walked in my son was sat on the sofa and my wife was in the kitchen making food for him. I got some food out for myself but had to wait for the microwave. Whilst waiting my step-daughter appeared in her pyjamas and I told her that she had to start behaving when I was out. My wife said she would do my food so I sat down. My step-daughter came over to me and put her arms around my shoulders and kissed me goodnight as she went off upstairs. That was the last time I ever saw her.

    I sat downstairs with my wife eating my food and doing some work on the laptop. A while later I suggested that we go to bed and watch some TV. She agreed and we went up. When I walked into the bedroom my son was asleep on the bedroom floor (nothing unusual for him) and I got into bed. We watched TV with my wife's arm over me before we fell asleep. I woke during the night and the TV was still on so I turned it off.

    The next morning the alarm went off at 6am but we both fell back asleep. My wife woke me again about 6.15am so I got out of bed, got dressed etc and left the house. Soon after I have left the house it appears she took the children in the car and drove over 2 hours to a police station near her parents home and made the allegations. From looking at the phone records I have found that she was on the phone to her parents for an hour the previous evening just after I had left the house ( call time is 6.10-7.10pm).

    I was released from custody on bail after about 27 hours. It didn't take long for the neighbours to find out what had gone on and my car was subsequently vandalised ( 4 slashed tyres, dents in bodywork, windscreen wipers pulled off etc). I was also threatened by a neighbour in the street and so I was forced to move house.

    I was rearrested a couple of weeks a go to answer more questions. They now allege that I also stuck my finger up her backside as they have found a scratch or something on it. I have never done anything of the sort to anyone in my life. I am now back on bail again.

    During the interview the police revealed that in the medical report it states that "Although there is no evidence of rape that is not to say it has not happened". The worrying part here though is that they also claim to have found traces of my semen on her underwear. I have no clue as to how this happened. My solicitor says that it could be from the washing basket, being in my bed etc. How could a 10 year be raped and there be no bruising, bleeding etc etc???? Also during the interview the police alleged that I had told her that if she didn't keep still I would make her take her clothes off. They looked a bit confused when I asked them how I could have been doing the things I am accused of if she had her clothes on at the time!

    Since all of this has happened I have been trying to work out what is going on. From phone records etc I can see that my wife had been calling hotels in the evening about a month before and had also been contacting estate agents about 2 months prior. Did she have this planned all along? I also found a piece of paper in my step-daughters bedroom where she was writing about how she was moving house. This was buried in loads of drawings etc so she must have known beforehand.

    You seem to have started your own defence already. Well done. Keep on doing that.

    Unfortunately the lack of injury (and the fact that a complainant is still a virgin after years of alleged full penetrative sex) comes from "statistics" taken from cases where there are convictions; some of them wrongful convictions.

    Under "Useful Information" you will find a thread that lists recommended (and not recommended) solicitors and barristers.

    What was the duty solicitor like? Did he or she inspire you with confidence?

      Solicitor is OK. It was the duty solicitor from a local firm.

      I just feel so useless in the meantime as they only really deal with me when I'm at the station and not inbetween.

        The sol won't get paid unless you are re-interviewed or there is a charge. There won't be any paperwork / disclosure / evidence at this stage so s/he can't really do a fat lot at the moment.

        If you can view the accuser's Facebook and that of her friends / supporting family members take screenshots of anything that might help in the future.

        You must not give any helpful evidence to the police you might find there as

        a) she would block you and

        b) she would change her version to suit.

          So sorry to see you here but anyway, welcome to the forum!
          You will find lots of useful info here but also lots of help and support from other members.
          We have all found ourselves here due to the crazy twisted minds of other human beings.
          I know for me personally, it's been a lifeline!
          My OH is currently on bail for rape/sexual assault and the lies these people have told about all of our families is unbelievable!
          Without the people in here I would've gone insane!!

            Hi all,

            Thanks for your comments so far.

            I have been looking at the PAFAA website and want to join the forum there as well. You have to provide a landline telephone number to do this and I don't have one. I can provide proof of identity such as driving licence, utility bills etc and could also scan and email my bail sheet?

                    Like everyone on here im so sorry that you have to find this site and that you have have been falsely accused.
                    I just want to give you information on the 'semen found on her underwear.'
                    My partner was accused of grooming along with another bunch of local men. Men he didnt even know !!

                    Anyway the police said they found his DNA on her underwear which was mind boggling. The only thing that could suggest this was if she had sex on his bed with his friend who shared the house with him at the alleged time. Our solicitor was cr@p and said the police couldn't make these statements up, they must have concrete evidence of this. We were told by someone on this forum that may not be the case. DNA could mean skin, saliva , hair and nails. This is an awful tactic that is used by the police and quite frankly it should stop 😡

                    Please make sure your solicitor is familiar with the police and the way they question suspects. It will help you tremendously.

                      Forensic reports that go before the courts should differentiate between saliva, semen, skin cells etc.

                        Hi,

                        They definitely said semen during the interview, They said her underwear had been "chemically screened" to find it. I do know that she spent hours in my bed on the day in question but this was with my wife and the other 2 kids watching TV. At no point did I get in there from when I got up in the morning until I went back to bed at night with my wife.

                        Solicitor is of the opinion that this may have got onto her clothing from things such as the washing basket etc. Also, when the clothes washing took place it was usual for the clothes to be put on the sofa and then the next person going upstairs would them up and put them on our bed. Later my wife would then put them away in the kids bedrooms etc.

                        One thing that I didn't think to mention during interview is that the utility room where the clothes were washed and dried was also my workroom where I spent hours everyday. I always placed my laptop on top of the washing machine and had my equipment for work on the bench above the tumble dryer. I would quite often have to move clothing out of the way before I could get on with my work.

                          I attended an appeal against conviction a few years back where semen had been found on a pair of shorts.

                          Turned out they had been not only in a mixed washing basket but different members of the family wore the shorts (!) in between washes.

                          In your case, if this is an entirely malicious allegation, it could have been planted. Try not to get too bogged down with that at the moment.
