NFA but still feel cheated ?!?!?

Got a phone call from the police saying she drop it all but she can start it back if she want I'm so mad I feel Iv bin cheated out of my day to defended my self in court and show her lie of what they are ! Is there anything I come do just feel like I'm mr did he or didn't he now plus we have a kid together will this come up in family court ?

Do you mean that they have decided to not press charges and have decided NFA (no further action) It sounds like it?

If so, you can begin to put this behind you which is great news

The police cannot resurrect a NFA unless there is fresh evidence to support it. Unless further allegations (or other evidence) come to light then that won't happen.

Well that odd cos the detective said my ex could start all this up again if she change her mind

She would have to comeback with more "evidence" - unless she made a false retraction, in which case, I can just imagine the cross-examination if that happened.......

I didn't realise that there is an appeals process after the police/cps decide NFA.
Is it right that the complainant has 3 months to appeal?
And does anyone know what grounds the appeal can be made on?

A complainant can "make representations" to the CPS, however if it was NFAd due to lack of evidence it's unlikely they would resurrect it; if it was resurrected and the def found not guilty then a complaint could go in for malicious prosecution if there is nothing there that would cause them to believe they have 51% or over chance of a conviction.

If convicted and an appeal succeeded, they would run the risk of being sued for malicious prosecution...... and compensation would come into it for wrongful imprisonment / loss of earnings etc.

The complainant could I suppose suddenly remember that she told "a friend" and she or he could be wheeled in for interview, to see if what they have to say can support her claims.
