  • Grandson accused of rape

    Just wanted to say a quick hello
    I have been reading some of the falsely accused posts on here, in the hope it may quell some of my fears. My 15 yr old Grandson has been falsely accused of raping a girl of a similar age over 2 years ago. She has only just decided to accuse him. Like everyone else the stress levels are through the roof. It is so frightening to comprehend the implications this fabrication of lies can lead to. Some of the horrors most people are put through seem unreal and we are struggling to get our heads together that in this day and age and in this country there seems to be nothing anyone can do to stop any female making these claims, it makes me ashamed of my Gender.

    The repercussions seem to be never ending, even if it goes nowhere or Nfa'd, cleared, not guilty, etc, the mud sticks ..... Ready to be slung whenever by whomsoever with no hope or guarantees it will never happen again.

    So sorry to see you here. That's because of the reason that has brought you here of course.

    I take it your son was interviewed with an appropriate adult with him?

      Hi Rights Fighter,
      It's my Grandson and his Mum was with him, he refused a Duty Solicitor, was interviewed, arrested and bailed with the usual procedures adopted.
      She is a single parent, with 4 children, SS have been to see my daughter and want to interview all 4 children my GS has atwin brother, and 7&4 yr old sisters,.... He is in bits, and has been under camhs in the past, self harm due to being bullied... I am so worried this is all going to go pear shaped.

      I cannot think coherently to put everything down and some of the things I'm reading about are scaring me more. I fear he will have no future, due to a very sick little girl who wants to play mind games... The effect this is having on the whole family is unbearable.

        Do bear in mind that much of what you are looking up on the web relates to adults.

        If I've understood your OP correctly your grandson and the girl were both around 13 at the time of the allegation.

        Nobody can really predict what it likely to happen but CPS policy regarding youths is less stringent than that relating to adults. Obviously a lot hinges on whether there actually was any sexual activity between them at the time (and I appreciate that your grandson may not wish to discuss this!) and if this was consensual (at the time!)

        I am reluctant to point you to any more unsettling reading but there a section of the CPS website relating to this, alternatively you may wish to discuss the matter with a specialist lawyer (though, at this stage, you may need to pay for any such consultations)

          I am not sure whether your GS could refuse the services of a solicitor given he is now only 15.

          As CH says, he must have been around the age of 13 when this assault is alleged to have occurred. This would put him in the "Doli Incapax" bracket, more so given his troubled background.

          He MUST get a solicitor (who knows the legal arguments surrounding "Doli Incapax" asap) - he might be eligible for legal aid even though there is no charge, due to his age.

          DI relates to age of a suspect and "mens rea" - knowing whether what he is alleged to have done is "wrong". The criminal age of responsibility here is 10 years although it can extend to 14 years.

          Roughly, where in the UK are you - or where in the UK did the alleged assaults take place? Don't name the town, just the county.

            Thanks CH I have read the CPS and youth offending info and feel a little more reassured that should this proceed he will be looked at as a 13 yr old.

            Hi RF when my GS was interviewed he was asked if he wanted a solicitor he said as many do... No I havnt done anything wrong... He was asked did he know why he was there before he was told of the allegation. My first question would be then should he have been arrested and interviewed without a Solicitor,?

            Yes both the girl and himself were 13 at the time, there is a little history with this girl but that might be for another part on this forum not Hello... I would be happy for it to be moved to the right location...

            He is in Lancashire about 50 miles away from Chris Saltrese, however I am going to call CS to see what the situation is both financially and location wise..

            Really appreciate this information guys I slept a little better last night. thank you

                  I don't know about that CH. I've known a couple of cases recently been chucked out (recent allegations) due to DI

                      My advice is a little different and I'm sure you are already doing this but one of the most important things a loved one can do in this situation is to provide unwavering support and care for the accused whatever the outcome. Having an allegation made against you and the threat of court and prison is terrifying for anyone of any age, and your grandson will definitely need a lot of care and support to keep him going. It's important to be strong around him and try to help ensure his mental health and self esteem etc is ok

                        I can't really contribute anything, my own case was over very quickly and now I'm back at work I find myself spending less time on the forum. Joe as usual has made a telling comment, I also found that any messages from anyone are a comfort, so I'm just acknowledging your post and wishing you and your GS a speedy and just outcome

                          Thank you, yes it is a comfort, I do hope we have a speedy outcome as well.

                          As a matter of interest how are you coping now... did you have any support as a victim? are you able to put everything behind you? I'm worried that the effect of this will have on my GS and his Brother never to be trusting of females, I know not all girls are like this and we have always warned them that they should always be respectful around girls, mindful of what they say and do and now to make sure they cannot be misinterpreted by deed or action. A hard lesson for boys of such a delicate age.

                            Thank you for commenting, fortunately, he knows he has our total support. We are trying to treat everything as normal and get on with things to take the pressure off him. We are encouraging him to go out as normal and get on with his plans for the summer holidays, it is us Adults that are stressing more because we are very aware of the chaos this could bring to the whole family.

                            By coming on here I have found strength in the welcome and support and realise every story is different, having never dealt with these kinds of issues before it is easy to get yourself quite hysterical... It is a beautiful world we live in with some very sad and scary places and people, I have long had a saying " people can only do to you what you alllow them to do to do" that refers to mindset, I remind myself of that saying and will press forward until this is sorted.

                              That's a great way to think about things!
                              Don't be surprised if there's days when you feel that you just can't do that anymore, it is inevitable to have bad days.
                              But keep those excellent thoughts at the forefront of your mind.
                              We are all facing a similar rocky road and sometimes it's an uphill struggle but positive thinking is underestimated.
