Good morning everyone
I've just had a phone call from the dc who arrested me and she told me the phone account has been nfa with insufficient evidence but the rape case is still going ahead
She told me the cps have asked for more information now over medical records which at the time of interview I got told there was none, now the dc has said they can ask to see if she logged anything a year or so later
She also told me the dates have now changed it's towards end of April 2013 rather than march they said there was some confusion at interview regarding this
I'm starting to panic now as I don't know what's happening and it seems the police have been lying to me from the start
Can someone advice me what I need to do over this pls

Hi there,

The cps have requested medical records - that might go in your favour as there might be no evidence? Sounds to me like they need more evidence to charge ie they currently do not have enough to charge you. I'm no expert but my gut tells me this will NFA. It might take a bit of time but really hope u get good news soon and. Your nightmare over. Keep us posted.

If you read some of the other threads you will see that this is not at all unusual. You will see some good advice on there, which you could take. Also don't forget that this is a self-help group. While you read other threads, maybe post up encouragement and you'll find you get more support back.

Could you tell me what the police and cps will think over her friends making statements and will these stand up as evidence even though they wasn't there at time of incident occuring and the ex partner supposedly texting them both the next day stating that I had raped her
Will these statements be taken in to account even though her friends and not independant witnesses

Hearsay evidence. It supports their case as hearsay is allowed in as evidence. The judge has to direct the jury that this is not evidence emanating from the complainant but from others, so it's up to the jury to decide whether it support the Crown's case, or not.

If the "evidence" emanates from the ex partner sending them text messages, but not from the complainant herself (sending messages or ringing etc) then I'd be surprised if it is allowed in as "recent complaint" evidence although might be used to support a very weak case, if that's what they are doing.

My girlfriend who is a staff nurse wants to speak to the police regarding this ex girlfriend making these allegations since we got together in the Feb of this year the ex girlfriend then made these allegations in the march of this year also, the ex girlfriend tried to contact me over a year and half ago when I was with someone else and she said she was going to make my life a living hell it seems funny that she is making these serious allegations when I'm with someone else and she lied about phone contract as well as rape
It's really effecting my girlfriend and she was wondering if she should go and see the dc who arrested me to let her know it's effecting work and our lives together any advice would be grateful

Pardon the French, but the police really do not give a sh*t as to how this is affecting the "suspect" or their supporters. Now if this was the complainant and her cohorts, their "suffering" would all form part of the "Victim Impact Statement".

Maybe the girlfriend could see her GP to see if there is any medication that will help her over this anxious period in her life.

Thanks RF for the information you have supplied me over this dramatic and life changing experience
I've been for numerous meetings with my sol and I've supplied him information and evidence stating my innocence, my ex girlfriend who he asked me to contact to see if she could supply a witness statement when the accuser ex girlfriend was last In touch over 18 mth ago she wrote to my sol stating she doesn't want to get involved

I've just had another letter today of my sol which I thought would be good news but no it was bad he has basically stated that even though we have enough evidence he is now waiting to hear back from oic or cps to see if they will charge or nfa

It feels like I've wasted money on a sol that's doing nothing to help me with this I'm growing very impatient with him and I don't know what to do wether to wait for verdict or change my sol

I found out as well when I last spoke to oic that my ex has stated the rape happened between march and April 2013 and we had a glass of wine on the Saturday night and the anal rape happened on Sunday morning 9.30-10am
She can give that information but can't give a date I just don't know why the police or cps aren't pushing her for a date she remembers everything else apart from date

It feels like I've hit rock bottom again

Can someone advice please on what I should do and if anyone can recommend a sol in the Manchester area

There isn't a fat lot that can be done before or without a charge being made. It's a shame you felt you had to pay privately though. We've had so many people on these forums NFAd (and NG verdicts) using LA solicitors and it usually isn't necessary, apart from the handholding and support you pay for.

All you can do now is to wait it out. Don't start looking for specialist unless you are charged. They can't actually do anything at this point.

As hard as it is, I would def agree with RF. You cannot do anything, apart from make copiuos notes with regards to a Private Eye or new solicitor. Until you are actually charged, nothing can be done.

I know, I have just been through this with my partner, yesterday we found out NFA - apart from a caution for receiving two illegal photos that FA actually sent.

When he was first arrested our knee jerk reaction was to find a Private Detective, and a new solicitor. We met with the Private Detective, but as he advised, until there are any actual charges nothing can be done.

I did go and see my GP around 5 weeks ago now, and was put on anti depressants. Not sure if they have helped or not, but get your current GF to pop in and see them. They also offered me counselling, which I declined as I had a very good support network of friends.

Hi I feel you are misunderstanding a fundamental part of this process. Your solicitor cannot really influence the decision of the police or cps as far as I'm aware. Can anyone confirm?

It is rare in my experience, that a solicitor can influence the outcome of a decision to charge, or not.

I've known on a very few occasions where a solicitor has advised the accused to ask a material witness to provide a statement. Later on the matter has been NFAd. However..... nobody can know whether that statement assisted, or not.

In a police force where the officers are are "encouraged" to meet Government-set rape conviction targets, this sort of evidence could be then transported back to the complainant, who will then change his or her story of the alleged events.

Paying privately prior to any decision to charge is largely helpful in a comforting / handholding capacity.

I'm sorry I've not been in touch or replied lately as I've been really trying to keep myself and my family busy, I've been popping on everyday to help me and this forum has helped massively if it wasn't for yourself and so many kind hearted people I don't know what I would of done, my family and my girlfriend have helped but they don't know what to say or do because they are not going through with this.
Anyway I'm due to be answering my 3rd bail on Friday the cps had had my file since August and I think they must have made there decision now as my sol rang me the other week and said that he had spoke to the oic and she was due to go on leave on the 12th and wanted this wrapped up before then, she also said she was still waiting for confirmation back from cps and she would let me know what the outcome would be either re bail or charge or nfa.
Everytime I got rebailed before she gave me over a weeks notice and this time nothing I'm so confused as I don't know what's going to happen my sol hasn't been in touch to let me know the outcome wether I'm getting charged rebailed or nfa
Could you advice me or anyone to let me know what I'm facing and what will happen does she have to inform him on what is to happen on Friday or what I'm absolutely terrified of the wrong decision

Well I've just found out I'm to be rebailed till Feb 2016 a further 2 mths
I spoke to the oic and she said they were hoping to have an outcome before now but the cps have put my file back as there is more serious crime rapes and assaults that take priority
That is a joke when I go back in Feb it would of been for a year this case
My oic told me it's been assigned to a lawyer now and they are viewing the evidence so I will have my decision in Feb or b4 I hope it's the right one I pray every night for someone to help me and see sense over this nonsense
Can someone advice me now on what will be happening with the cps and is this a good sign that my file has been pushed back
Really beginning to stress again so wanted 2016 to be the start of a new me and future but no I'm still sitting on the fence waiting for my verdict 😢😢
