    I've just joined up today as my world came crashing down 2 weeks ago when I was arrested and FA of fraud and rape of my ex girlfriend

    I just can't seem to get my head around all of this I haven't heard of her in 2yrs and and then the police come round and arrest me and say these allegations have come from my ex
    Being locked up in a cell for 5hrs waiting for the duty solicitor and having my DNA and fingerprints and picture taken was the worst thing ever

    How it all started was my ex girlfriend opened a phone contract in her name with both phones in a shop and said I could use the phone until the end of the contract. I paid for numerous stuff around her house bathroom suite which I fitted and presents for her kids on my credit card when we split she told me i could have the remainder of the contract till it finished as I had stuff on my card so it was split 50/50 we split cos she cheated on me and she had a problem with cocaine and I have 2 young children which I didn't want them exposed too.
    That was that and then as I say I heard nothing for 2yrs and then this

    The police asked me about the phone I told them I used it till the contract finished and then I opened up a new one for myself, she told them I rang up orange and opened up a contract with her bank details in Jan 2014 which I never did the police have no evidence she said I committed fraud on her account, the police went round and asked her and then she through the allegations of rape in which supposedly happened in March 2013 we stayed together till the June of that year

    I just can't seem to get my head around this at all I'm panicking I'm on bail till September and I don't know what the outcome will be
    Can anyone advice me please

    It is a bit of a mind blower when it first happens, for gods sake don't read of cases on the net to see what the possible outcome of your case might be- it may well panic you! The articles aren't representative.
    There isn't much you can do until the cps make up their minds to the next step. The best thing to do is to try to remember EVERYTHING you can about the alleged incident and write it all down in case something helpful slipped your mind in the interview.
    If you don't have a solicitor Chris Saltrese is a good bet, but I don't know if you can claim legal aid or not. Keep posting when you know more, there's always someone around who can help.

      Thanks jittery I am reading everything about what has happened to other cases and how many innocent people have been sent to prison, I just can't seem to get my head around this I just hope the cps see right through this and nfa me
      Is it best to ring Chris saltese and explain my situation or just wait to see if they charge me ??

      I will be writing everything down now snd gathering as much evidence as I can to prove my innocence

        Really- don't look at other cases- second guessing and wondering about them will drive you insane!!

        You can't predict any outcome in my experience - you just have to try and take each day as it comes which is very very difficult at first. Start trying to remember anything and everything you can that might be relevant- make notes but keep it to yourself!!

        You're in the right place for support and advice- we've all been in the same place one way or another.

          Thank you again I'm trying to stay positive and upbeat it's just still so raw and I don't understand why someone could be so evil and vindictive and try and ruin my new life with my girlfriend she is my rock and is standing by me every step of the way as well as my family

          So do you think I should contact Chris and explain the situation to him ?

            God only knows why people do these things!!
            There are a multitude of reasons, none of them valid.

            I'm not a legal expert, but I think the general opinion is to engage a solicitor IF you are charged.
            Hopefully Rights Fighter will pick up this thread

              Thank you Amanda for your advice I've started getting the ball rolling by writing everything down and speaking to the right people if I do get charged hopefully it won't come to that but I'll have every bit of evidence I can get my hands on all paper trail, dates, statements everything to give to my solicitor

                There isn't much any solicitor can do at this point unless there is a charge. Ringing up for advice will probably result in them saying "unless there is a charge there will be no paperwork to consider, so I cannot really advise at this point".

                If you have a lot of evidence that you feel might exonerate you, but do not want to share with the police, he may be able to advise you on that, however you would have to pay him. If you feel ok with that then go ahead and ring him - his number is on my "signature".

                Hold on in there and see what happens at the next bail date.

                  Thank you rights fighter I'm gathering all the evidence I need over the fraud investigation and hopefully it will see how much she has lied about everything and then they should take into account that she has also lied about the rape charge

                  I know it's going to be a long drawn out case but I'm going to fight this all the way to clear my name

                      Hi everyone it's been a rocky and unstable couple of weeks now regarding my case I've been up and down like a roller coaster but I'm just about coming to terms now with what is happening

                      I appointed a sol called tim mcardle of olliers solicitors in Manchester and I've gathered all my evidence and witness statements stating I wasn't in the house or area at this time of incident, does anyone know if my sol is any good or if he has defended anyone on here and the outcome if any
                      I waited for my duty sol but he did nothing and when I tried to contact he never got back to me so this is why I instructed tim as my sol

                      Ive been told my case has gone to cps and the reason it has gone is because my ex has 2 friends as witness statements stating she rang them the day after which is a lie, the police couldn't find any evidence regarding phone contract in 6mths but I found it myself after digging for half hour with orange my sol has all the evidence and statements as I don't want the police to have these as I know they are after conviction rates

                      I'm answering bail on the 22nd that's if I don't get re bailed again until then

                      Can anyone offer any advice now on my sol and outcome of cps as I'm getting more nervous by each passing day now

                        My head is a mess and I'm really angry now my sol who I instructed on my behalf has told me the dc who arrested me for fraud of a mobile phone account and the rape are now dropping the fraud case NFA which means they are now trying to pin the rape on me which never happened
                        Why can't they now see that my ex is lying over both allegations
                        My sol told me they won't get away with this as the cps should see right through her lies now the rape only came along when they went round to investigate the fraud allegation they should dismiss both ( why are they stalling ) it's tearing me and my loved ones apart
                        They should see that she is lying over all this and just want this to be over but I know it's gonna drag even longer now
                        Anyway my sol is drawing something up now with new evidence which states I wasn't on the house or area at time of incident I was celebrating my bday early with friends who have made statements over this also if I was a rapist why would I take her out for meals and pay her rent in cash after this has happened it's all on my statements
                        Will the cps and police take this into account when we show them
                        Can someone advice me now on what will happen now

                          I don't think anyone will be able to tell you what will happen next but I can explain why the fraud allegation was dropped so easily and that because for the CPS to discontinue a rape allegation two specialist lawyers must both look at the evidence (or lack of!) and agree the NFA.

                          This doesn't apply to fraud of course, I'm afraid it's different goalposts for the two sorts of cases.

                            Thank you CH I totally understand that there both different cases
                            But if they show that she was lying over the fraud and she only said about the rape when the police interviewed her they should now see that she is lying about the rape
                            I just hope the cps see the full facts when my sol admits more paperwork to show my side and evidence

                              Most of the cases on the forum involving malicious allegations by ex partners end in a NFA so the odds are on your side but the CPS are working on the basis of whether they are 51% likely to get a conviction and, to be fair to them, they don't know you or your ex personally, so can only make a decision based on the paperwork.

                              Obviously if they have decided to drop the fraud case because that won't stand up in court this must influence their decision over the rape case, but as I mentioned this will not be made as quickly.
