I'm new to this forum, so I thought I'd write a post detailing my current position to see if anyone out there can offer any help, advice or has been through similar. My case is pretty unusual, even within the realm of false rape allegations. I was arrested on 3 counts of rape and sexual assault in January and placed on a condition free bail (apart from not contacting the claimant) until March. I was informed then that the police had concluded their investigations and handed the file over the CPS and I was re-bailed until July 1st. On 30th June, I was told that the police hadn't received the file back from the CPS and I was re-bailed again until October 5th. That's the current legal state of play; I'm trapped in limbo waiting for the police/cps to remove their thumbs from their arses.
Now to the nature of the allegations myself. In spring 2013 I employed the claimant in my business; their was a strong mutual attraction fairly early on and within a month or two we began dating. We had a normal relationship for about 7 or 8 months, but we began to argue by early January 2014. She dumped me and promptly offered her resignation in writing; presumably I was meant to beg forgiveness and be desperate to keep her (she's the vain type) but I didn't (I'm the vain type too!) and accepted the resignation and the end of our relationship without a great deal of fuss. Obviously annoyed with my response, she filed a formal grievance against me as her employer. As it was against me in my capacity as a business owner, and was a professional matter, it was treated as such. A internal investigation was conducted by my business in accordance with employment regulations and her claims ultimately dismissed.
Undeterred, she got a no-win-no-fee solicitor to take her "case" on as an employment tribunal; her evidence almost exclusively consisting of out of context text messages. After 6 months of protracted legal back and forth, her solicitors finally looked at our version of her "evidence" of me being some kind of manipulative ogre and immediately withdrew from supporting her. We agreed to not pursue her for costs (as we stated we would do) as she doesn't have any money, but on the proviso she signed a non-disclosure agreement with a settlement amount agreed if she wrote about the matter on social media etc. It had been a long, 11 month battle, but it seemed like everything was finally over and I would be able to move on with my life.
Within a week of her employment tribunal case collapsing, she walked into a police station and accused me of 3 counts of rape and 3 counts of sexual assault. No mention of these allegations had been made during the employment tribunal, just a whole host of other spurious accusations. A few weeks later, the police arrived at my flat at 7.30 in the morning and arrested me. I was taken to Pendleton station by Greater Manchester Police, kept in a cell for 4 hours, questioned and then eventually released on bail.
My defence, I hope, is pretty strong. I obviously have all the files relating to the tribunal, as well as testimony from ex-girlfriends of mine and even a statement from her house-mate during our relationship (and one of her oldest friends) stating that this never happened (all her friends have abandoned her in disgust as they know the allegations are untrue).
Ideally, the police and the CPS will see this for what it is; a vile, malicious act from a vengeful egotist, but it's 6 months and counting since I was arrested, and still nothing has been resolved. I don't think I will be charged, but given the current climate around rape cases, this is not something of which I can be sure. I also have no idea how I will proceed once my name is (hopefully) cleared. Any advice or help that anyone can give me would be greatly appreciated.
