  • Bail Cancelled

    Hi,

Just wondered if anybody had any thoughts/experiences around this situation. See below:

I am writing to formally advise you that following a discussion with my Detective Inspector I am now CANCELLING your bail commitment on...

I have now to submit an 'evidence' file to the Crown Prosecution Service so that they can make a definitive decision about the case and this may still take some weeks/months to complete.

I apologise for the length of time this is taking but unfortunately a number of higher priority cases have taken precedence.

Whilst I am sure that the imposition of bail has not been a hinderance to you I do not feel that it is proportionate or necessary to keep you on this type of 'revolving' bail until a decision is made. You have made every effort to comply and I am mindful of this.

Many thanks for your patience and I will advise you of any outcome as soon as I am aware.

I know that you want to read something positive into this but do bear in mind that this letter might just be a spin-off from the recent public furore about the length of time folks are on bail.

On the other hand as there is now nothing to stop you upping sticks and moving to a non-extraditable country, the OIC probably thinks you aren't guilty......

I understand that someone should only be bailed if conditions are going to be applied. It would appear to me that they are removing your bail conditions but also like CH has advised......... there has been recent bad publicity regarding the length of time people are on bail.

Maybe I am cynical but I suspect their way of dealing with such cases is by removing bail and then their statistics look better and it appears they are adhering to their instructions????

Their 'imposition of bail has not been of hindrance to you'???? What about addressing the anxiety, stress of waiting.

And sometimes bail doesn't really have any restrictions apart from having to answer to the next bail date. If bail is cancelled then that's all that has happened. Until you get an NFA (or charge - hopefully not) it can go either way. Try not to read anything into it.

I got a NFA also, I hope it gives some encouragement to others

              Hi,

After about 10 months I got an 'NFA' and an apology for it taking so long. I don't know whether the police officer was just being nice but he was decent in his email.

              Here's the email:

              Dear XXXXXXX

I am writing at the earliest opportunity to inform you that the investigation in relation to XXXXXX has been fully reviewed and it has been decided to take NO FURTHER ACTION due to there being insufficient verifiable evidence to support the allegation.

I would be grateful if you could acknowledge receipt of this by reply email and of course I will try to answer any questions you may have.

I apologise once more for the time that this has taken to complete which has been due to a number of factors including digital forensic analysis (which are outsourced), CPS backlogs and of course the distances between locations. I appreciate that this has been a frustrating time for you and your family but I hope this early email can bring closure for you.

As an investigator I have to remain impartial and I have tried to conduct a fair and proportionate investigation of the available facts many of which were frustrated by the historic nature of the allegation.

I would like to thank you for your patience and understanding and assure you that the matter is now closed and exists only as a stand alone computer record held within XXXX Police records. I would emphasise that this was an investigation and there are no findings of guilt or impropriety on your behalf.

I am sure you have no intentions of doing so but I would respectfully ask you not to contact Ms XXXXXX as this may only lead to further 'allegations' being made. I ask you purely out of courtesy.

I believe that all of your property has been returned to you and also reiterate that any bail commitments were cancelled previously and remain cancelled.

There are absolutely no restricitons on your personal freedom.

              Regards

It's not sunk in yet with us.... We still feel as though we're still under the threat. But anyway, we've got through it so far. Hopefully that's the end of it.

It just perpetuates the problem. We need fundamental solutions, not just this kind of witch hunt, much like the war on terror, the war on drugs before it and the war on gays before that!.

              Good luck you guys,

I moved your last post to your previous thread as more folks are likely to see it in that section; as you said it will give encouragement to those members still going through the process.

Have got the business out of the way, what great news and such a pleasant email from the OIC....bananas on the way

I asked him whether I should keep all my own investigation/research work (I use to be a private investigator myself in a former life for insurance companies ...mainly against police who were putting in false injury claims, but I didn't tell them that at the time!! ) and he said any future amended versions would be viewed with scepticism.

I believe the person who filed a complaint suffered from Borderline/Narcissistic Personality Disorder. She made the claim shortly after her ex- girlfriend dumped her to start a relationship with a male. During the time we've been waiting for an outcome, it would appear she started a new relationship with another female so when the OIC had spoken to her again, it seems she wanted to put the whole thing behind her.

B/NPD people have a tremendous fear of abandonment and so will lash out at people. The story she had told police was like an amended version of what she had told me a decade ago. She obviously forgot that bit and so I think this was a case of projection/transference.

NPD's are notorious for smear campaigns. This kind of thing is like nectar to an NPD as it gives them everything they crave. Attention, Money, Power over others, the ability to exploit. They have absolutely no empathy and will cut their own noses off to spite their faces. They're like terminators, they just won't stop. If you're up against a NPD, it's not likely there will be any medical evidence because they rarely self diagnose because they believe they're perfect. NPD is part of the dark triad of socio/psycho-pathology but more scheming than impulsive.

Fortunately there was no evidence to back her version of events and lots to show otherwise. Had it gone to court, it would have become obvious I would hope.

Thankfully it's not got that far. I really do feel for others going through the mill. We're slowly reconnecting our life back together as it's been on hold for practically a year. Having to re-establish websites etc and contacts which, although frustrating, seems like a blessing now!

Gerry Mc was very helpful along the way.

THE OIC's final email when I said "There is no justice...it just is!"

                              I hear what you say!

As far as this investigation is concerned then I can confirm that it is now closed due to insufficient evidence. Ms XXXXXX has said to me that she now wants to put matters behind her and 'forget' about it which encourages me to think that she will not be making any further allegations. Of course if this were to happen we would need to assess it in isolation but as things stand I am satisfied that she has had ample opportunity to tell her entire story and I am not expecting any further contact from her. I think it would be fair to say that any 'amended' version would be viewed with a degree of scepticism.

                              Best Regards
