  • Son

Hi, Just needed to sound off.

Not quite sure what to do.

My son has been accused of rape by his ex girl friend all because he broke off the relationship.

He is 15 and she is the same age all be it 2 weeks older.

Every body that knows her say she is a very disturbed person and that she should not be trusted.

The accusation is that he forced himself on her back in November, it was his first sexual experience and she provided the condoms, which she is denying, there is no actual evidence it is her word against his.

The accusation was made a week ago but do not know what to do. Do I employ a solicitor now or wait until he has been charged?

Very worried and do noy know where to turn.

Hi and welcome to the forum,

I have moved your post into this section as it seemed more appropriate.

If you have a look at this thread, you will note there are quite a few similarities to your situation and so some of the advice offered will be pertinent

      Thank you.

Never been on a forum before so not sure how it all works.

I will have a look at the post.

I know that many people are going through this so any help is welcome.

He has been interviewed, yes? Was an appropriate adult in attendance?

Yes he has been interviewed with his mum and a duty solicitor who I must say came across really well.

He also gave them his phone and offered his computer which they declined.

Both my wife and I gave statements so I suppose it is now a waiting game.

As of yet he has not been formally arrested, which I assume is a good thing.

Just waiting does not seem right and I feel as though I should be doing more and taking a more proactive part.

Any suggestions are welcome and I have found reading the comments on this forum very helpful.

I am very pleased to see that the solicitor came across well. There are some really good duty sols out there, and sadly, some rubbish ones.

            Please do keep us updated.

              Hi landy,

I'm not sure how to do it on here but I think if we could get in contact it would help.

Our son is going through almost the EXACT same as yours and its killing us, really feel your pain. If you know of a way to get in touch privately let me know.

              Many thanks
              K

                Hi K,

Sorry for the late reply, not sure how you can privately communicate either.

It is an awful feeling of uselessness and not knowing.

At moment, unlike your son, our son has not been charged but questioned under caution.

If I have read your thread correctly you are using Gerry that is mentioned by many on this forum, are you paying or is he representing you under legal aid?

I know the duty solicitor we had came across well but like all parents we want the best for our son.

It is very hard especially when you know that they are 100% innocent.

Please keep me informed on how your son gets on.

Just had a call from the OIC, who was good to his word as he did say he would phone today with any news, there is to be no further action to be taken on the allegations but they are looking to charge the accuser with wasting police time and the false allegation.

The DC said it was unpresidented for the investigation and a decission to be made so quickly.

My son has to go to the police station tomorrow to collect his phone and to show them any messages that might be relevant from the accuser that they could use.

The solicitors where really good and have also spoken to the police today and they have told us there is no need for them to be present.

I have asked if I can post their details and they have agreed, they will not take on any action being brought against the police but will take on all other criminal work and are accredited police station representatives.

                  Their details are : IBB Solicitors, Robert Corbin, 01895 207921, after hours 0870 442 15500, web: ibblaw.co.uk.

Thanks to the reply's and thanks for a fantastic forum, reading the other posts made me realise we where not the only people going through this.

I realise how fortunate we are for this to come to an end for us and now it is just starting for the accuser.

Good luck to everyone on the forum and I will be looking in wishing people all the best.

                  Landy

That's great news in more ways than one!

I have asked if I can post their details and they have agreed, they will not take on any action being brought against the police but will take on all other criminal work and are accredited police station representatives.
Why do you mention taking action against the police? They had no choice but to investigate of course

Could you post the solicitors details in the thread on this link

                    http://www.daftmoo.org.uk/mooforum/s...2765#post52765

......otherwise it will get lost in the posts on here and newer members won't think of looking on here for representation

Hopefully the accuser will get more than a slap on the wrist..... I doubt she will be named due to her age....

Sorry, probably the way I constructed the sentence.

When I asked if I could post his details he said he defends people in all criminal cases but would not take on a case that involves a complaint against the police.

Hope that makes it more clear, sorry.

Already posted the details there too as I thought they might get lost in the thread over time.

Thanks for the bananas Casehardened, much appreciated.

Jolly dee! I added that about the police as some people who have been NFA'd then try to "take action against the police" - which would fail if the progress of the case was pretty quick and straightforward. I often post so others will take note too!

Thanks for posting the details on the sols thread!
