I searched Hilary nothing much came up, I have also tried to contact Gerry as he's highly recommended on here, just want to know who is right for us, right now just feel whatever we do feels wrong! This shouldn't be happening, her lies are ruining our lives. Wish she could just be honest and straight so this could be over!

Have you emailed Gerry? I think he picks them up on his phone although not sure about that. If he's at trial or doing a prison visit obviously he can't answer immediately.

Yes I have emailed him, I'd like to speak to him before We make a decision on who we want to instruct, just feel so broken right now, need to look forward and prepare for the fight! Just not sure what to do

Hi - we used Chris Saltrese and Tania Griffiths. Chris specialises in historical cases. They were both amazing and were lovely lovely people. There were adept at dealing with the games that CPS appear to play.

Gerry has also been mentioned in your thread - I've spoken to him a few times and he was very nice. He has a brilliant reputation.

All the best..........you're right -it is hard to understand why people can try to destroy our live. But once you receive more information - it may fall in to place. It certainly did for us. That does not make it easy to get thru each day but it will give you something to focus on and prepare for the battle.

Is it 100% that our case will go to crown or is there a small chance IT could get thrown out? At mags
Also we are looking to instruct a private solicitor that specialises in these cases. Do we need them at mags or will it save money to do mags with a duty?

The visit to mag court is very short. You'll probably spend more time waiting around to be heard. All that happens is that hubby will have said he is pleading not guilty and it will be bumped up to Crown. Nothing else really happens.

Very rarely are these cases thrown out at this stage. If they are thrown out it's usually either just before or during the trial.

Gerry McDonald specialises in these cases as you have seen from the many posts from other members. However it is up to you who you choose to represent you.

Would you advise we need a specialist for mags or would it be a waste of money at this stage. I've heard of a few cases being thrown out at mags, Im on the fence ive been informed it will be immediately forwarded to crown. But always have hope as its based on her lies.

Hi - I hope someone else can answer for you but I think Mag. to Crown can be approx. 6 months.

I don't think our sol came to any of our mag courts. At the first 'quick' one - I think he sent a local sol. who could then report back to him what had happened. I can't remember much else - sorry.

There is no specific timeline between Mag and Crown. Some might have a matter of weeks to wait and some several months.

It's rare that cases are thrown out at Mag and that usually has nothing to do with how good the sol it but more to do with potential abuse of process or other stuff - very very very very rare it's on the evidence of the complainant.

My husbands case took four weeks to go from magistrates to crown for the pre-trial, and its 6 months from that first Crown date to the trial itself. We had a junior barrister accompany us at the magistrates hearing. It really is a formality and lasts no longer than 5-10 minutes. He wont even need to make a plea at this stage.
