Thank you for all your replies, I just don't know what to do for the best, as to weither it will save money not having a specialist at mags and instructing at a later date closer to crown,

My husband has been charged with historical rape and indecent assualt. We are currently waiting for it to go to trial in the summer, so are busy working in defence.

My advice re solicitor is to instruct the one you feel will do the best job for you as soon as possible. This way, you will get to know them and feel more comfortable when it comes to the crunch. At the beginning the solicitor will not have much contact with you as they will be waiting to get all the details from the CPS, but this is when you will need to put together a timeline and your version of events, so that when he /she receives the CPS pack, they have some background to go on. However, as Rights Fighter has said, what you do is up to you.

I have spoken to Gerry, we now need to make a decision who to go with, he also hasn't heard of Hilary?!
Really not sure what to do. Mags is just round the corner, why so many decisions and so much hurt over lies!

We cannot make the decision for you.

The most recommended legal aid solicitor in your area is Gerry. He also takes on private clients if you prefer somebody in your locale.

If you wish to pay privately, the most recommended solicitor in England not in your locale, as far as the members on this forum who have used him for trial are concerned, is Chris Saltrese www.chrissaltrese.co.uk contact details on the website.

None of us can make the decision for you.

This is entirely your call. Nobody else's.

Thank you for your advice, question with legal aid do you have the same solicitor and barrister all the way through?

You have the same solicitor all the way through, though the barrister will possibly change

I have had a chat with Gerry, but feel he thinks we aren't commited, we are 100% commited to whoever my parner chooses to Instruct, but as G feels this I'm worried he will not take on our case if we wish to instruct him
                    ??!!

Did you ask his opinion about the other solicitors you have mentioned in this thread?

Trust and confidence is a two-way street and I suspect that Gerry feels that if you aren't 100% certain he is the right man to represent your partner, then it is probably better that you select someone who you are completely confident with.

I appreciate that you are not sure who to instruct, and this is indeed a dilemma, but all we can do, and have tried to do, is to indicate what other members opinions of their solicitors who have represented them and hope you would consider these genuinely unsolicited testimonials when making your decision.

Obviously it is wrong that you need to be making these choices at all, but unfortunately he is where he is and that is in the situation where there is no alternative to having to defend his position.

                          Sorry to be so blunt.....

I'm sure it must be difficult to choose a sol but no need to over complicate. Phone some of the ones recommended and have a chat to see if they can help, and see who you feel most comfortable to work with. I'm sure most of them have enough work so I imagine they don't need to prove themselves, and like anything it relies upon client and professional having a good working relationship. All that said, I have not had to Instruct a solicitor for this specific purpose so maybe others can offer better advice than me.

Plus of course Gerry is a VERY busy solicitor, and having potential clients taking his time up by ringing/emailing etc to ask him his opinion of other solicitors, and asking the same questions over and again, could be construed as time wasting, if this is what Swirl has been doing. Given the repetitive questions on here which have been answered, I can only assume that that is what has been going on.

Gerry has a lot on his plate with cases in which he is instructed, and using up his goodwill can only last so long, before he cracks on with the work he is being paid to do.

We completely understand he's very busy, we were not wasting time just considering using him I explained i had spoken another solicitor, he stated he had not heard of her. That was all we then spoke about the case.
We emailed him to see if legal aid was an option.
He has an excellent track record, without the positive information from the forum.
We appreciate all everyone has said on here with responses etc
We will commit to whoever we Instruct of course it goes without saying.
                                Sorry for going on
