    Hi,
    I was wondering on here if anyone can give me some advice.
    About 6 years ago my son was arrested for rape after a girl accused him of forcing her to perform oral sex on him. He was arrested and questioned but never charged and received a NFA notice within a couple of weeks. The problem is that he has now applied to join the police force after completing a university degree in police studies but he has been rejected at the vetting stage due to this rape allegation as it remains on his PNC record

    The background to this incident is as follows, my son had a party at home and had invited a load of his friends including this girl. He was 19 at the time and I think she was 15 but was in the whole group of friends. By the end of the night my son was laying down asleep when he awoke to find that he had been unzipped and this girl was trying to perform oral sex on him. He pushed her away and she seem somewhat aggrieved about it. No more was said and a couple of days later she sent him a message on facebook apologising for it. A couple of months later her father was going through her facebook messages and found this particular message and made her go to the police to report it. My son was arrested and then questioned on this and bailed. This girl then went on to tell my sons friend that she had made this allegation up as her dad had found out she had gone to this party without his permission and she was trying to protect herself. She then went out also to accuse my sons friend of rape. After a couple of weeks both my son and his friend received NFA's and they both thought that was the end of the matter.

    However, my son has now found out he is being rejected from joining the police service as this rape allegation is still on his record even though he received an NFA.

    Does anyone know if anything can be done to close the police record down as it is really destroying my son as he has spent a great deal of money on university fees and tution in getting qualification to join the police as that is all he has ever wanted to do and now due to this false allegation he is being prevented from doing so.

    I would be really grateful if someone could give me some advice on this as it is really not fair on him or others in his situation that these sort of false allegations never go away and are being held open indefinitely

    This is such a shame for your son but I believe that the fact that he has been arrested (and presumably the reason for it) will remain on the PNC for ever. Any other employer would only be able to carry out a DBS check which probably wouldn't show this as the allegation rightly ended with a NFA but of course the police can and will look on the PNC to investigate the background of any potential candidates.

    I doubt you will be successful in getting this entry removed from the PNC but I wonder if different forces might have different criteria and if he might be accepted as a recruit elsewhere, after all he had done nothing wrong apart from being a young lad!

      He has had a enhanced DBS check for the part time job he has and the arrest does not show at all and it is completely clear. It is just when the police did their vetting checks the record of arrest is still sitting on the PNC and because he was arrested under the sexual offences act the record remains open. What get me is that he put this arrest on the paperwork when he applied for the police and it passed the initial sift as they said they were happy it was an NFA, but when it went to vetting they said as it was still an open case he could not be accepted. To be honest I don't think any other police force (in this country at least) would allow him entry as this is still showing as an open crime.

      Even if he can's get this removed from his PNC record, does anyone know if there is any recourse if he can get it recorded as a No Crime, especially due to this girl subsequently admitting she made the allegation up. Even the police at the time said they only arrested him as a matter of course due to the rape allegation and they said they were happy with what he said happened.
