  • Husband accused of attempted rape....how do I prove his innocence???

    Hi all,

    I am new to this site and anything like it as I have never had to do anything like this. We found out 72 hours ago that my husband and partner of over17 years has been accused of attempted rape by a friend of a friend's daughter in another country. She is 21 years old. Although I am hurt, stunned, gutted, angry and an array of emotions I KNOW my husband is innocent of attempted rape.

    The friends he was with on that night have also confirmed they do not believe he did this and the girl made advances to him and he wrongly responded to them which he has admitted to and the next day she panicked and cried rape.

    I have had a full account from my husband who has fully admitted everything to me and I 100% believe that he is telling the truth and she was consensual to everything in actual fact she suggested most things.

    The accusations were made a few weeks ago and a statement was taken from the friends daughter here in the UK, my husbands friends that he was with have had to give statements and were told they could not tell me or my husband what had happened. Finally they asked the police if they could tell us as they did not think this was fair and they agreed. My husband has spoken to a solicitor and he has told him to just wait and not contact the police as his arrest will be imminent and probably by English police as the allegations were made in the UK not in the county the alleged attempted rape too place however the police who took the statements from his friends said he would be arrested by police from the country it happened in...does anyone know what is correct?

    Please can someone let me know if they have been through anything similar?

    I've just read what you posted and am a bit worried about your user name - hopefully it isn't your actual name as this is an open forum and anyone can read it, if it is then one of the moderators can edit it for you - just let us know.

    I can't clarify the position of whether it will be UK police or police from the country where the accusation was made but as the UK police have already been taking statements I wonder if it might be them but hopefully someone else might be able to clarify.

    It's good you've already managed to speak to a solicitor and he's right in not contacting the police, does he specialise in these kind of cases? If not if you could give a rough idea of where you are someone might be able to recommend one for you.

          Is this 'another country' outside of the UK or within the UK? I am not asking you to name the country - this is a public forum and can be viewed by non-members.

          If it is outside the UK, hubby cannot be prosecuted here for something that allegedly took place abroad.

            I believe this has been relaxed in recent years, as one of the charges against my husband related to an alleged incident in Cyprus in 2005.

              Really? Why did nobody tell me?? LOL

              I've recently dealt with appeals where "something" was alleged to have happened in Canada and another one in Spain - defendant was not indicted on those as out of the UK.

                I just assumed it was a European co-operation type arrangement, I think the Cypriot authorities had to give permission , will check with my husband when he gets in. The alleged incident happened on restaurant steps, my husband bombarded Chris with pictures that showed the restaurant had no steps !

                I do know that long distant historic allegations such as those against Max Clifford in Spain in the 80's were not allowed to have charges attached, but that didn't stop the CPS allowing the complainant to give her witness statement as supporting evidence.

                  Thanks for that. I take it the photos were used!

                  For every false allegation there is a real victim who does not get justice because he or she is not believed. Such a depressing job when you think about it. Victims everywhere.... victims of FAs and victims of abuse who never get justice.... very sad....

                    Outside of the UK but in Europe.

                    So if and when he is arrested it would be by the countries police that it allegedly took place in? The friends he was with have had statements taken (one over two weeks ago) but my husband has heard nothing from police?

                      Was your husband arrested by Cypriot police in the UK or in Cyprus? Where was his case originally reported .

                        I don't know. I'll try to find out for you. I think that UK police would probably be able to interview him on behalf of the other country's police force but will get advice.

                              Just had this helpful advice:

                              "They expanded the law when Gary Glitter was abusing children in Thailand, to incorporate a U.K Citizen who commits a sexual offence abroad will be treated as having committed the offence in the U.K. I recall watching a documentary about this at the time".
