    Hey bootsand suits,

I felt an urge to respond to your post.
I'm not very familiar with your story please forgive me, I would just like to say I'm so so sorry your having to go through this. I can't even imagine what your going through. I've not been falsely accused, my heart goes out to you. I'll pray that god gives you peace and truly helps you get through this. I wish I could just hug you, I'm a wired I know. I can truly sense your pain and how lonely you must feel.
Don't you have any close friends or family you can talk too? Have you ever considered counselling, you might benefit from it. It helped me a lot) I can't be much to you. Other than offer some emotional support to you, perhaps you can start a daily journal expressing your feelings, anger in a safe functioning place. It helped me)

I'm not familiar with your story but why do you keep moving address? I would of thought that one of bail conditions would be to remain in a fix address? If I'm wrong I apologise.

    Relating to your upcoming trial)
Hopefully your confident with your defence team) as you have said all her inconsistencies and texts hopefully that goes in your favour)
Early this year I did my jury service on a rape case, and speaking from experiencing it's damn hard convicting someone of rape. Juries are not stupid well most of them are not. They can see through fake tears. Well most of the times they can)
Yes every case is different but overall, it's still very hard to convict someone of rape.
And lastly yes this will sound so cliche but whatever the world throws at you. You must hang on to the truth!! And your sanity ) they can take everything from you, like your career, family and friends but no one can take your joy, or peace or your sanity.
The truth never changes it always remains the same!!

Think of the trial like going to battle) your fighting for yourself! Fighting to clear your name, fighting for your future! Fighting for your son!! I'm sure you already know this!!

I hope I've been some sort of help to you tonight.
Hey mister don't give up hope)
I pray the trial goes well
Wish you the best of luck

    • You know, anyone with any common sense would look at the "evidence" and think what a load of rubbish, but there is no common sense in these cases.
What? Are we all to be held accountable for the attitudes of years ago when nobody was taken seriously?

We are being used to prove a point- that the police actually DO listen to women, even when they are lying out of their backsides.
Unfortunately what these selfish idiots don't realize is the more they fabricate stories, the more difficult it is for those who are real to be heard so there we all are, back on the treadmill.

I hope the jury see this for what it is- absolute nonsense.

Even if it's acquittal or not guilty, it is so so hard to pick up the pieces of our former lives, if at all. We live with the stigma while our FA's carry on as though nothing has happened. They are the true criminals here.

Keep us posted, hang on to the truth and the hope that others will see it too.

      • B&S there was a case recently where the def was found NG. The court allowed previous allegations made by the complainant into the evidence, despite the fact that they were not proved to be false

        http://www.getsurrey.co.uk/news/surr...-rape-10321296

        Extract:

        Previous Allegations

Ms Darby also informed the jury that the woman had made a number of allegations against males in the past.

She said: “When you were 16-years-old you made a sexual assault allegation against a co-pupil.”

The court heard the student was arrested but police took no further action.

Ms Darby also said the alleged victim made another allegation of sexual assault in March 2009, saying an ex-cadet leader had touched her leg and bra strap.

The man was also arrested and interviewed but no further action was taken.

And in November 2008, she made a sexual assault allegation against her step-grandfather, claiming he fondled her breasts and touched the elastic of her knickers.

On that occasion, police arrested the man but later dropped charges.

This surprised me, as I know that applications relating to previous unproved allegations have not succeeded in the past.

Clearly they are admissible under some circumstances so it might be worth your while pointing your solicitor and barrister in the direction of this case. He might think it appropriate to make a similar application.

        • Thank You

Thank you all for the support as always just to reply:

Firstly Bene thanks you for your kind words they really do mean so much I have taken a lot of your advise on-board. You are right one of my bail conditions is to have a fixed address and as far as the Police are concerned I do, But that is with my dad who is a very up and down man at the best of times and this allegation has pushed him back to drinking and when he drinks we fall out and he has thrown me out more times than I can remember when hes had a few!! So I thought best to stay between other family members and one of my friends that has stuck by me.

AmandaF thank you too I cant believe how her word which is frankly not a lot at all is allowing such a wishy washy case to continue to proceed, your right we are seemingly all victims (the innocence ones) of the past and the systems gone into over drive to send every man accused straight to prison!!

RF thanks as always I read that article and it is very interesting to know this is possible I have been told by Sol that it cant be used so I will revisit that one on Monday

Thanks again all keep the good vibes coming x

Hopefully you have told the police of these problems and that sometimes you stay overnight at another address.

if you have not, then you could end up being remanded into custody for breaking the bail conditions.

              • Trial counsel in that case was Rachel Darby. Hopefully your sol / barrister will contact her and ask for her assistance in arguing in that evidence.

She must have produced a strong argument for it to be deemed admissible by the trial judge.

There are a couple of barristers of that name

There may be more. The above two could also be the same one if she's moved Chambers.

if your address is not part of your bail conditions (you must be absolutely sure of that) then you should be ok to stay at different addresses.

However if your address is THE bail address you really should be careful. I've known people end up on remand due to breaching their conditions due to not staying at the bail address.

You don't have to tell the police you have already stayed elsewhere, but it might be a good idea for you to ask them to clarify that, "on the off-chance you might need to stay elsewhere is that ok?"......

                      • Bail Address

I was told by my sol that a bail address was somewhere the cops could contact you if they needed to and that it was inadvisable to stay away for more than 6 nights without notifying. I even went to Spain whilst i was on bail. And Warsaw. I took advice from the sol on this one as the police in my OH's case had me on lock down before I was even charged with anything myself.

Always best to take advice as it seems to differ depending on who you speak to.

I meant the barrister whose links I have posted up

That sort of suggested that you were hoping that Rachel Darby, the barrister (from the case I posted up), will contact you and your sol........ otherwise, why would she contact you or the solicitor?

Or do you mean that you hoped your solicitor will contact you and Rachel Darby, the barrister?

                              • As long as you have not tried to make direct contact with the barrister Rachel Darby, in the case I mentioned above, that's ok.

It is for the solicitor or your own barrister to do that. They might or might not know her personally, but they can make contact with her if they think it will help. Her arguments to get the previous unproven allegations into her case, must have been very strong. Hence the suggestion that your defence team contact her......
